Risks and insurance. 83.1 The Employer provides these insurances from the Insurance Table (i) Insurance against loss of or damage to the services, Plant and Materials comprising Contract Works Insurance, SASRIA Special Risks Insurance and Marine & Air Cargo insurance; and (ii) Insurance (Public Liability Insurance) against liability for loss or damage to property (except the services, Plant and Materials and Equipment) and liability for bodily injury to or death of a person (not an employee of the Contractor) caused by activity in connection with the contract; Note: The terms and other matters applicable to these insurances provided by the Employer (and to insurances generally) are detailed in the insurance schedule attached as section C1.4 to the contract (“the Insurance Schedule”).

Risks and insurance. 6.1 The Provider is to ensure all risks of the New Supply Housing Project are adequately and suitably covered, whether by insurance or otherwise. M
6.2 Where any insurance policies are identified in the Key Terms, the Provider is to: E P
(a) effect and maintain, or cause to be effected and maintained, the identified insurance policies:
(i) for at least the minimum amount specified in the Key Terms for any one occurrence and in the aggregate; A
(ii) with a reputable and financially sound insurer; L
(iii) on terms which a prudent and experienced person performing work of a nature similar to the work the subject of the insurance could reasonably be expected to obtain; and E
(iv) from the date of the commencement of any construction works in relation to the New Supply Housing Project until the completion of the Development Phase;
(b) within 10 Business Days of a request by MSD, provide MSD with evidence that the identified insurance policies are effected and maintained;
(c) except for an amount of less than $10,000.00 and where the claim is in relation to an event which does not affect the safe occupation of the New Supply Properties or delivery of the New Supply Housing Project, notify MSD of any claims under any of the identified insurance policies; and
(d) subject to the terms of any Financier Direct Deed, use the proceeds of any claim under any of the identified insurance policies to reinstate the New Supply Properties, or as otherwise agreed by MSD and the Provider.
6.3 Without limiting the obligations of the Provider in clause 6.2 of this Schedule 9, the Provider is to ensure that any contractors, subcontractors, consultants, or other third parties involved with the delivery of the New Supply Housing Project effect insurance policies on terms and covering risks that a prudent and experienced person performing work of a nature similar to the work the subject of the insurance could reasonably be expected to maintain obtain.

Employer’s risks 80 80.1 The following are Employer's risks. • Claims, proceedings, compensation and costs payable which are due to o the unavoidable result of the service or of Providing the Service, o negligence, breach of statutory duty or interference with any legal right by the Employer or by any person employed by or contracted to him except the Contractor or, o a fault of the Employer or a fault in his design. • Loss of or damage to Plant and Materials supplied to the Contractor by the Employer, or by Others on the Employer's behalf, until the Contractor has received and accepted them. • Loss of or damage to the Affected Property, Plant and Materials due to o war, civil war, rebellion, revolution, insurrection, military or usurped power, o strikes, riots and civil commotion not confined to theContractor's employees or o radioactive contamination. • Loss of or wear or damage to any Equipment, Plant and Materials retained by the Employer after a termination, except loss, wear or damage due to the activities of the Contractor after the termination. • Additional Employer's risks stated in the Contract Data. The Contractor’s risks 81 81.1 From the starting date until the end of the service period, the risks which are not carried by the Employer are carried by the Contractor. Indemnity 82 82.1 Each Party indemnifies the other against claims, proceedings, compensation and costs due to an event which is at his risk. 82.2 The liability of each Party to indemnify the other is reduced if events at the other Party's risk contributed to the claims, proceedings, compensation and costs. The reduction is in proportion to the extent that events which were at the other Party's risk contributed, taking into account each Party's responsibilities under this contract.

83.1 The minimum limit of indemnity for insurance in respect of death of or bodily injury to employees of the Contractor As prescribed by the Compensation for Occupational Injuries and Diseases Act No. 130 of 1993 and the Contractor’s common law arising out of and in the course of their employment in connection with this contract for any one event is: liability for people falling outside the scope of the Act with a limit of Indemnity of not less than R500 000 (Five hundred thousand Rands)..
Risks and insurance. A. Excepting all labor and the value of work for Hopeman and all materials and components and equipment and elements intended to comprise the Interior, all risks of damage to or destruction of the Vessel, to all machinery, materials and equipment provided by BUILDER and any OWNER Furnished Items timely reported by OWNER to BUILDER under this Article, and all liability to or for labor employed by the BUILDER and subcontracted effort arranged for by the BUILDER on or about the Vessel from the time the Vessel is delivered and released to the BUILDER during conversion (including Trials) and up to redelivery and acceptance shall be the responsibility of the BUILDER. Full form Builder's Risk Insurance acceptable to OWNER (including loss or damage caused by strikes, locked-out workmen or persons taking part in labor disturbances or riots, or civil commotions, without deletions of protection and indemnity and collision clauses, and including risks of earthquakes, with endorsements attached covering losses or damage caused by vandalism and malicious mischief) will be maintained by BUILDER at BUILDER's expense and cover the cash value of BUILDER's work in progress, the value of timely reported OWNER Furnished Items and, notwithstanding the initial sentence of this paragraph excepting the Interior from BUILDER's uninsured risk, include in such coverage the timely reported value of work in progress by Hopeman. BUILDER shall invoice OWNER monthly for the premium cost of the Builder's Risk insurance for the declared Hopeman and Owner Furnished Items and OWNER shall pay such invoice with 14 days. BUILDER shall maintain Workmen's Compensation, Longshoreman's and Harborworker's Compensation not less than minimum required by statute, and Public Liability Insurance of $5,000,000. BUILDER shall provide relevant copies of insurance policies prior to signing of this Agreement. OWNER and OWNER's subcontractors, including specifically but without limitation Hopeman, shall maintain workxxx'x xxxpensation, longshoreman's and harbor worker's compensation insurance not less than the minimum required by statute, and public liability insurance of $5,000,000. OWNER and OWNER'S subcontractors shall provide relevant copies of insurance policies prior to commencing any work at BUILDER's shipyard or on Vessels.
