Design-Build Price Generally. The Design-Builder shall be entitled to receive the Design-Build Price for the Design-Build Services on a progress basis in accordance with the terms of this Section. The Design-Build Price shall be the sum of the Fixed Design- Build Price and the Fixed Design-Build Price Adjustments.

Design-Build Price Generally. The Village shall pay the Company the fixed Design/Build Price for the Design/Build Work in accordance with the terms of this Section and Appendix 6 to this Agreement. The fixed Design/Build Price, as may be adjusted by any Design/Build Price Adjustment as set forth in subsection 9.3.3 of this Section and Article X, shall be the Company's entire compensation and reimbursement for the performance of the Design/Build Work and the design and construction capital costs including, but not limited to: the costs of design and engineering, Governmental Approvals and permitting, insurance, bonding, construction of the Wastewater Facilities, obtaining all Utilities that the Company will require to perform the Design/Build Work, commissioning and Acceptance and Start Up Testing of the Wastewater Facilities, correcting all non-conforming Design/Build Work, operating the Wastewater Facilities during the Acceptance and Start Up Tests and prior to the Acceptance Date, operations transition, and performing all repairs and replacements. In no event shall the Company be entitled to any payment for the Design/Build Work in excess of the fixed Design/Build Price notwithstanding any cost overruns that the Company may incur.

Design-Build Price Generally. SRWA shall pay the Company the Design-Build Price for the Design-Build Work. The “Design-Build Price” shall be the sum of the Base Design-Build Price and any Base Design-Build Price Adjustments. The Company acknowledges that the construction materials and supplies to be acquired by the Company or any Subcontractor in connection with the Design-Build Work are subject to State sales and use tax and that these taxes have been priced into the Base Design-Build Price. Company therefore shall pay all such taxes without reimbursement from SRWA. The Company agrees that the Design-Build Price shall be the Company’s entire compensation and reimbursement for the performance of the Design-Build Work and for all costs and expenses incurred by the Company in performing the Design-Build Work through to Final Completion.

Related to Design-Build Price Generally

  • DAF Specifications Developer shall submit initial specifications for the DAF, including System Protection Facilities, to Connecting Transmission Owner and NYISO at least one hundred eighty (180) Calendar Days prior to the Initial Synchronization Date; and final specifications for review and comment at least ninety (90) Calendar Days prior to the Initial Synchronization Date. Connecting Transmission Owner and NYISO shall review such specifications to ensure that the DAF are compatible with the technical specifications, operational control, and safety requirements of the Connecting Transmission Owner and NYISO and comment on such specifications within thirty (30) Calendar Days of Developer’s submission. All specifications provided hereunder shall be deemed to be Confidential Information.

  • Technical Specifications The Technical Specifications furnished on the CD are intended to establish the standards for quality, performance and technical requirements for all labor, workmanship, material, methods and equipment necessary to complete the Work. When specifications and drawings are provided or referenced by the County, these are to be considered part of the Scope of Work, and to be specifically documented in the Detailed Scope of Work. For convenience, the County supplied specifications, if any, and the Technical Specifications furnished on the CD.

  • DELIVERY: FOB DESTINATION, INSIDE DELIVERY, FREIGHT PAID Whenever possible, contractors should give the ordering entities 3 working days prior notice of any deliveries and/or installations. Furniture contractors will not be responsible for the removal/moving of existing furnishings unless requested by the ordering entity. Contractors should verify site readiness prior to delivery. All deliveries will be made during normal working hours unless otherwise arranged with the ordering entity. Contractor will communicate any scheduling delays and/or changes immediately. Agencies will not be responsible for any freight damage, concealed or otherwise.

  • Aircraft Basic Price The Aircraft Basic Price is listed in Table 1 and is subject to escalation in accordance with the terms of this Purchase Agreement.

  • Equipment Specifications All equipment must meet the contract specifications and all federal and State safety codes and regulations in effect at the date of manufacture. All equipment must be Original Equipment Manufacturer (OEM) equipment unless otherwise stated in the contract. All products, materials, supplies, replacement parts, and equipment offered and furnished must be new, of current manufacturer production, and must have been formally announced by the manufacturer as being commercially available, unless otherwise stated in this Contract.

  • The Specifications The Specifications are that portion of the Contract Documents consisting of the written requirements for materials, equipment, systems, standards and workmanship for the Work, and performance of related services.

  • PRICING STRUCTURES Licenses and Support Services for the Licensed Programs to which this OST applies are granted according to the pricing structures mentioned in the related Transaction Document. Standard pricing structures are defined in the section “DEFINITIONS” of this OST, even though those pricing structures may not be applicable to the DS Offerings to which this OST applies. Other pricing structures may be made available on a case by case basis.

  • Delivery Location All Goods shall be delivered to the address specified in this Order (the "Delivery Location") during Buyer's normal business hours or as otherwise instructed by Buyer.

  • Quality Specifications SANMINA-SCI shall comply with the quality specifications set forth in its Quality Manual, incorporated by reference herein, a copy of which is available from SANMINA-SCI upon request.

  • Delivery Schedule The Goods specified in the List of Goods are required to be delivered within the acceptable time range (after the earliest and before the final date, both dates inclusive) specified in Section V, Schedule of Requirements. No credit will be given to deliveries before the earliest date, and Tenders offering delivery after the final date shall be treated as non-responsive. Within this acceptable period, an adjustment of [insert the adjustment factor], will be added, for evaluation purposes only, to the Tender price of Tenders offering deliveries later than the “Earliest Delivery Date” specified in Section V, Schedule of Requirements.
