DeveloperTrAILCo Obligations. DeveloperTrAILCo shall, at its own expense, operate, maintain and control the Large Generating Facility and the Developer AttachmentSystem Upgrade Facilities owned by TrAILCo, including the Transmission Facility, in a safe and reliable manner and in accordance with this Agreement. Developer shall operate the Large Generating Facility and the Developer Attachment Facilities in accordance with NYISO and Connecting Transmission Owner requirements, as such requirements are set forth or referenced in Appendix C hereto. Appendix C will be modified to reflect changes to the requirements as they may change from time to time. Any Party may request that the appropriate other Party or Parties provide copies of the requirements set forth or referenced in Appendix C hereto. and the PJM Tariff.
DeveloperTrAILCo Obligations. In accordance with applicable NYISO requirements, Developer shalland subject to Appendix C, TrAILCo shall install and maintain satisfactory operating communications with Connecting Transmission OwnerNYSEG and NYISO. DeveloperTrAILCo shall provide standard voice line, dedicated voice line and facsimile communications at its Large Generating Facility control room or central dispatch facility through use of either the public telephone system, or a voice communications system that does not rely on the public telephone system. Developer shall also provide thethe equipment, labor and contract services and dedicated data circuit(s) necessary to provide DeveloperTrAILCo data to Connecting Transmission OwnerNYSEG and NYISO as set forth in Appendix D heretoin accordance with applicable NYISO and NYSEG requirements. The data circuit(s) shall extend from the Large GeneratingTransmission Facility to the location(s) specified by Connecting Transmission Owner and NYISONYSEG. Any required repair, replacement or maintenance of such communications equipment shall be performed by DeveloperTrAILCo. Operational communications shall be activated and maintained under, but not be limited to, the following events: system paralleling or separation, scheduled and unscheduled shutdownsoutages, equipment clearances, and hourly and daily load data. Prior to the Commercial Operation Date, satisfactory communications shall be in place, in accordance with this Article 8.1 and Paragraph B(2) of Appendix C.
