Common use of Discontinuation Clause in Contracts

Discontinuation. Extended tours may be discontinued in any unit when: i) fifty percent (50%) of the employees in the unit so indicate by secret ballot; or ii) the Employer because of: A) adverse affects on patient care, B) inability to provide a workable staffing schedule, states its intention to discontinue the compressed work week in the schedule, C) the Employer wishes to do so for other reasons which are neither unreasonable nor arbitrary. When notice of discontinuation is given by either party in accordance with B) above: 1) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and 2) where it is determined that the compressed work week will be discontinued, affected employees shall be given sixty (60) days notice before the schedules are so amended.

Discontinuation. Extended tours may be discontinued in any unit when: i) fifty sixty percent (5060%) of the employees nurses in the unit so indicate by secret ballot; conducted by the Union or ii) the Employer Hospital, because of: A1) adverse affects effects on patient care, B2) inability to provide a workable staffing schedule, states its intention to discontinue the compressed work week in the schedule, C3) where the Employer Hospital wishes to do so for other reasons which are neither unreasonable nor arbitrary. , states its intention to discontinue the extended tours in the schedule. iii) When notice of discontinuation is given by either party the Association or the Hospital in accordance with Bparagraph (b) above:; then 1) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and 2) where it is determined that the compressed work week extended tours will be discontinued, affected employees nurses shall be given sixty (60) days notice before the schedules are so amended.

Discontinuation. Extended tours may be discontinued in on any unit after a trial period of twenty-four (24) weeks when: (i) fifty fifty-one percent (5051%) of the employees in the unit so affected nurses indicate by secret ballot; or (ii) the Employer Centre because of: A(1) adverse affects on patient care,, or B(2) inability to provide a workable staffing schedule, states its intention to discontinue or (3) where the compressed work week in the schedule, C) the Employer Centre wishes to do so for other reasons which are neither unreasonable nor arbitrary, states its intention to discontinue extended tours in the schedule. When notice of discontinuation is given by either party in accordance with B) aboveparty, then: 1(i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and 2(ii) where it is determined that the compressed work week extended tours will be discontinued, affected employees nurses shall be given sixty (60) days days' notice before the schedules are so amended.

When notice of discontinuation is given by either party in accordance with B) aboveparty, then: 1(i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and 2(ii) where it is determined that the compressed work week extended tours will be discontinued, affected employees nurses shall be given sixty (60) days days' notice before the schedules are so amended.

Discontinuation. Extended tours may be discontinued in any unit when: i) fifty percent (50%) 60% of the employees nurses in the unit so indicate by secret ballot; or ii) the Employer Employer, because of: (A) adverse affects effects on patient care, (B) inability to provide a workable staffing schedule, states its intention to discontinue the compressed work week in the schedule, (C) the Employer wishes to do so for financial constraints, or (D) other reasons which are neither unreasonable nor arbitrary, states its intention in writing to the Union to discontinue the extended tours. When written notice of discontinuation is given by either party in accordance with B) abovethen: 1i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and 2ii) where it is determined that the compressed work week extended tours will be discontinued, affected employees nurses shall be given sixty (60) days 60 days' notice before the schedules are so amended.
