Discontinued Items. Discontinued items must be marked on the OETC Pricing Template and submitted to xxxx@xxxx.xxx to be removed from the contract. If an OETC member purchases a product that is no longer available, but was not designated so by the Contractor, it will be the responsibility of the Contractor to ship an equivalent or better product at the price of the purchased, discontinued product.
Discontinued Items. If a listed item has been discontinued, bid on manufacturer’s replacement item or a comparable item and indicate in the quotation form the item is a replacement item along with the Manufacturer’s Name and Catalog Number of the item being bid. Manufacturer’s descriptive literature shall be submitted with your bid response to be considered.

Nortel shall notify Mirror at least [***] before Nortel discontinues accepting orders for an item of Nortel Equipment sold under this Agreement; provided, however, that if Nortel offers Nortel Equipment for sale that is equivalent in form, fit and function to the discontinued Nortel Equipment, the notification period may be shorter than [***] but in no event shorter than [***]
Discontinued Items. During the contract term, the Contractor must contact the Project Officer if any item on the Exhibit B: Pricing Schedule has been discontinued or is no longer available. The Contractor shall provide a suggested replacement that is similar in price and specification to the discontinued or no longer available item. If the Project Officer approves the replacement, the contract must be updated via an amendment.

In the event an item is discontinued by the manufacturer during the life of the contract, another item may be substituted, provided that the contracting officer makes a written determination that it is equal or better than the discontinued item and provided that it is sold at the same price or less than the discontinued item.

In the event that the manufacturer/supplier replaces a specified product(s) with a new product(s), the Responder will notify the Purchasing Agent indicated on page one (1) in writing, and will apprise the District of product replacement options in accordance with the markup percentage established in Attachment A, and/or any cost reduction available for the specified product(s). The District reserves the right to authorize such product replacement and/or cost reduction on any specified product(s).
