Dismissal For Those Who Did Not Work Overtime. The Parties understand and agree that there are 115 AMC employees during the Settlement Period who have not opted out and are not entitled to overtime compensation under this Agreement. More particularly, the reason for these employees not participating in the Settlement is that upon review of payroll and time records, the Parties stipulate and agree that: (1) these individuals did not work any overtime hours in any of the three states involved in this action for which they were not fully paid under state and federal law; (2) these individuals, if the matter were to go to trial, would not recover anything even if Plaintiffs were successful in all of their claims; and (3) these individuals are not entitled to any relief under state or federal law for unpaid overtime in any of the three states involved in this action, or related penalties, for the time period covered by the Settlement Period. In filing their motion for approval of settlement of this Amended Agreement, Plaintiffs will file an unopposed request that any remaining opt-in class members, who are neither participating in this Settlement nor had their claims dismissed via the Court’s summary judgment motion, are dismissed from the class based upon the facts above.

  • Compensation for Holidays Worked a. With the exception of the provisions in Section C.2.b., below, an employee required to work on a holiday listed above shall be paid at the employee's regular straight-time rate of pay for the hours actually worked. In addition, an eligible employee shall receive either compensatory time off or holiday pay at the option of the University at the regular straight-time rate, including any shift differential.

  • HOLIDAY COMPENSATION FOR TIME WORKED 126. Employees required by their respective appointing officers to work on any of the above specified or substitute holidays, excepting Fridays observed as holidays in lieu of holidays falling on Saturday, shall be paid extra compensation of one additional day's pay at time- and-one-half the usual rate in the amount of 12 hours pay for 8 hours worked or a proportionate amount for less than 8 hours worked provided, however, that at the employee's request and with the approval of the appointing officer, an employee may be granted compensatory time off in lieu of paid overtime as provided for elsewhere in this contract. 127. Executive, administrative and professional employees designated in the Annual Salary Ordinance with the "Z" symbol shall not receive extra compensation for holiday work but may be granted time off equivalent to the time worked at the rate of-one-and-one-half times for work on the holiday.

  • Supplemental Employment Benefit for Maternity and Parental Leave 8.5.1 Effective April 1, 2002, when on maternity or parental leave, an employee will receive a supplemental payment added to Employment Insurance benefits as follows:

  • Pay for Holidays Worked (a) When an employee is required to work on a designated holiday, the employee shall be paid compensation, or given compensatory time off, for such work at the rate of time and one-half the employee’s regular rate of pay, in addition to regular pay received for all hours worked for the holiday.

  • Standard Work Week The standard work week shall be thirty-five (35) hours and is composed of five (5) consecutive standard work days.

  • Standard Workweek Except as noted below the standard workweek for full-time employees consists of five (5) consecutive eight (8) hour days, Monday through Friday each week. Non-overtime hours and starting and quitting times for such employees shall be the same throughout the standard workweek. The standard workweek does not apply to the following:

  • REGULAR WORK YEAR FOR TEACHERS 20.1 The annual salary established for employees covered by this agreement shall be payable in respect of the teacher's regular work year.

  • Compensation for Holidays Falling Within Vacation Schedule If a paid holiday falls on or is observed during an employee's vacation period, he/she shall be allowed an additional vacation day with pay at a time mutually agreed upon by the Employer and employee.

  • Overtime Work Definition Overtime for non-exempt employees working any work schedule is actual time worked in excess of forty (40) hours per workweek.

  • Requirement to Work Reasonable Overtime The Employer may require any Employee to work reasonable overtime at overtime rates and such an Employee shall work overtime in accordance with the requirement.
