Disposal of the account. The account holder has the right of disposal of the account, and also the person or persons who have been given power of attorney by the account holder. If a trustee or executor has been appointed, the right of disposal is determined by the decisions and regulations which from time to time apply to the said persons. Xxxxxxx retains the right to, without prior notification, make withdrawals from the account holders account in order to cover fees and charges attributed to the account, or a service connected to the account. Xxxxxxx also has the right to charge the account with a sum equivalent to the fee, costs and expenses for commissions carried out on the account holder’s behalf as well as for payments for other overdue debts/receivables which Xxxxxxx has towards the account holder. If the account holder has given Xxxxxxx instructions to make transfers from an account, then the account holder is responsible to ensure that the requisite funds are available in the account at the time of the transfer. If in the event of a funds transfer, the said account experi- ences a deficit balance, Xxxxxxx retains the right to transfer back the funds from the receiving account. The account holder is in full agreement that those commissions and instructions which are submitted to Xxxxxxx which require the use of the account hold- ers personal identification number for the internet service, are binding for the account holder. Xxxxxxx will not carry out the requested withdrawals if the ac- count lacks the disposable funds and Xxxxxxx is not obliged to notify the account holder if an assignment is not carried out. Those services which are offered may change in the future. Information about current services is provided on Akelius website. The account holder is not entitled to compensation as a result of operational disturbances which makes it difficult or even prevent the use of the services. The account holder as well as Xxxxxxx, has the right to decide if and when an account or service is to be terminated. If payments are to be made, these take place in accordance with the particular terms and conditions which are applicable for the respective type of investment product.

Disposal of the account. 3.1 General 3.1.1 Changing or replacing the Account Holder with another person is not permitted. In the event of the Account Xxxxxx's death, Hoist will make payments of deposits to a third party only insofar as such third party gives sufficient proof of her/his right to dispose of the deposits through documentation which Hoist, in its reasonable opinion, finds adequate for this purpose. 3.1.2 Hoist reserves the right to block the savings account or to refuse a transaction in the event of suspicion that the savings account is being used by an unauthorised person, or if Hoist is obliged to take such action for other reasons. 3.1.3 The Company may debit the savings account with payment for overdue receivables that the Company has towards the Account Holder (set-off). Offsetting may not take place against salary, pension or comparable funds. 3.2
