Disposal of Transmitted Checks. Upon confirmation of crediting of your deposit to your account you agree to: o Mark the check as “Electronically Presented” or “Void” o Properly store the check to ensure that it is not presented again for payment by you or any other person. o Retain all checks deposited through Mobile RDC for a period of 30 business days following which you will dispose of the check in manner that will prevent its being presented again, such as by shredding the check. o Promptly provide us at our request with a copy of any retained check to aid in the clearing and collection process, to resolve claims by third parties, or for our audit purposes.

Returned Checks. Any credit which we deposit into your account immediately following a transaction initiated by you will be a provisional credit. If a check that you deposit using the Service is returned or charged back on your account, it will be deducted in full from your account along with any fees that are incurred due to the check’s rejection as described in our Fee Schedule and Account Agreements. We are not responsible for any losses incurred as a result of deposits returned on your account.

We have no obligation to accept for deposit any check you transmit using the Mobile Deposit Service: (a) if more than one check is included in the transmission; (b) if you have already transmitted five checks using the Mobile Deposit Service on that Business Day; (c) that is in an amount greater than $5,000; (d) if the amount of the check would, when added to the amount of checks you already transmitted for deposit as of that Business Day, would exceed $10,000 or (e) if deposit of that check would cause the sum of the amounts of the checks you transmitted for deposit using the Mobile Deposit Service within the previous 30 days period to exceed $50,000. We reserve the right to modify these limits at any time and will provide you with any notice required by applicable law or regulation. You may deposit checks using your Mobile Device Monday through Friday. Accepted deposits made prior to 3 PM Pacific Time on a Business Day will be credited by 6 PM Pacific Time the same Business Day. Accepted deposits made after 3 PM Pacific Time or on a day that is not a Business Day will be credited the following Business Day.

If you fail to promptly provide the original check or a reasonable copy of the check in response to a request by us, you agree to request a new check for deposit from the check's originator. If you fail to provide any copy of a check and cannot obtain a new check from the originator, you agree that we are authorized to debit your account for the amount of the check in question if we deem this action nece ssary. You will be solely responsible for any losses incurred as a result of the failure to promptly provide a retained check or replacement check in response to our request.

You agree to retain all checks you have deposited through the Service for at least twenty-one (21) business days and following the twenty-one (21) day retention period, you agree to dispose of your check in a manner which will ensure the check will not be presented again.
Disposal of Transmitted Checks. The member will ensure the safety and integrity of original checks from the time of receipt until the time of destruction. The member agrees to securely store the original check for a period of sixty (60) calendar days from the date of the Image transmission. During the Retention Period, the member agrees to promptly (no later than 10 calendar days) provide the original check to the Credit Union upon request. Upon expiration of this Retention Period, the member shall securely destroy the original checks transmitted. The member hereby indemnify the Credit Union for, and hold the Credit Union harmless from and against any and all claims, demands, actions, and causes of action, losses and damages, of whatever nature, related to the retention and destruction of original checks by the member. Receipt of Remote Deposit and Notification: The member agrees that they shall be solely liable for, and the Credit Union shall not have any liability whatsoever to the member for, any Remote Deposit or the Images or other information contained therein that are not received by the Credit Union. Said member also agrees to be liable for Remote Deposits or the Images or other information contained therein that are intercepted or altered by an unauthorized third party or dropped during transmission. Member agrees that the Credit Union does not have an obligation to accept a Remote Deposit and, therefore, the Credit Union reserves the right to reject any Remote Deposit or the Images or other information contained therein transmitted through this Service, at the Credit Union’s discretion. Unless required by applicable law, the Credit Union has no obligation to notify the member of the rejection of a Remote Deposit or the Images or other information contained therein and shall have no liability to the member for failing to do so. The member may receive a confirmation email upon receipt of a Remote Deposit. The receipt of such confirmation does not mean the transmission was error free, complete, or will be considered a Remote Deposit and credited to the member’s account. Notwithstanding the fact that the Credit Union has accepted a Remote Deposit for processing, any credit made to the member’s Account shall be considered provisional until the final settlement of the deposited item. The member shall remain liable to the Credit Union for any errors, inaccuracies, breach of warranties, and any other loss sustained by, or claim made against, the Credit Union.
Disposal of Transmitted Checks. You agree to retain the physical original of any Check or item transmitted through the mRDC Service for a period of at least 14 calendar days following your receipt of confirmation that the image was received. Thereafter, you must either destroy the original physical Check or item that you transmitted as an image, xxxx it "VOID", or otherwise render it incapable of further transmission, deposit, or presentment. During the time the retained Check is available, you agree to promptly provide it to the Bank upon its request.
