Diversion Data Sample Clauses

Diversion Data. On or before February 15, 2010, and annually thereafter during the 730 term of this Agreement, CONTRACTOR shall deliver to CITY diversion data for the specific 731 services performed under this Agreement during the preceding full or partial calendar year in a 732 format approved by the CITY. If CONTRACTOR fails to submit the diversion data in the 733 required format by February 15th, it is agreed that CONTRACTOR shall be deemed to have 734 waived the RRI rate adjustment for that year. CONTRACTOR’S failure to provide the diversion 735 data shall not preclude CITY from applying the RRI using the prior year’s financial data, or pro 736 forma data if no prior year financial data is available, if that application would result in a negative 737 RRI. 738 4.06 Adjustments to Disposal Elements.

Diversion Data. On or before February 15, 2021 and annually thereafter during the term of this Agreement, the Company shall deliver to the County diversion data for the specific services performed under this Agreement in the format specified by the County. If the Company fails to submit the diversion data in the required format by March 15, County may give notice to Company that County intends to not apply any rate adjustment to the Service Rates for that year. Should Company fail to provide the diversion data within ten (10) days of such notice, it is agreed that the Company shall be deemed to have waived the entire rate adjustment to the Service Rates for that year.

  • Data Encryption Contractor must encrypt all State data at rest and in transit, in compliance with FIPS Publication 140-2 or applicable law, regulation or rule, whichever is a higher standard. All encryption keys must be unique to State data. Contractor will secure and protect all encryption keys to State data. Encryption keys to State data will only be accessed by Contractor as necessary for performance of this Contract.
