Dredging Responsibilities. Lessee will be responsible for performing or causing to be performed all dredging, both new work and maintenance dredging, required for any slip on or adjacent to the Leased Premises and for access to the Aransas Channel from the Leased Premises. Any slip on or adjacent to the Leased Premises must be maintained by Lessee at a sufficient depth to prevent vessels berthed at the dock from striking bottom due to lowering of the water level from passing vessels.

Dredging Responsibilities. Lessee will obtain and maintain a US Army Corps of Engineers Permit for any construction and maintenance dredging of the Leased Premises (the “USACE Permit”). Lessee is responsible for performing or causing to be performed all maintenance dredging and agrees to meet the terms, conditions and requirements of the USACE Permit when performing maintenance dredging. The Leased Premises must be maintained by Lessee at a sufficient depth to prevent vessels and/or barges moored at the Leased Premises from striking bottom due to lowering of the water level from passing vessels.
