Duties of Nodal Officer during Termination i. At any time, not earlier than 90 (ninety ) days prior to Termination but not later than 15 (fifteen) days prior to each termination, the Nodal Officer shall, in the presence of a representative of the Operator inspect the Domestic Cruise Terminal for determining compliance by the Operator with the provision set forth in Article 17. and if required cause tests to be carried out at the Operator’s cost for determining such compliance. If the Nodal Officer determines that the status of the project site including domestic cruise terminal building and domestic cruise terminal area is such that its repair and rectification would require a larger amount, it shall recommend retention of the required amount in the Escrow Account and the period of retention thereof.
