Duties of the Vendor. The Vendor is liable for the Consultant’s performance of the Service in accordance with good IT practice. Unless otherwise is specifically agreed, the Consultant is entitled to free use of the Customer’s equipment, including its computers, telephones, printers, IT-solutions etc. during the performance of the Service. The Vendor pays the cost for the Consultant’s equipment such as mobile phones and laptops, but not for equipment and software that the Consultant must procure in order to provide the Service. The Consultant shall notify the Costumer on relations the Consultant understands may affect the performance of the Service.
Duties of the Vendor. The Vendor shall provide products and/or provide the services which are specified in its response to a RFP, bid or other written estimate which is attached hereto, or which are set forth below. The Vendor agrees to provide: HD5 Propane at a flat per gallon price of $1.07 for the term of this agreement and per the specifications listed in the Request for Proposal (RFP) provided by the Melba School District (MSD). The flat per gallon price is the total product cost including markup, market price fluctuations, any and all applicable taxes, surcharges, tank rental costs and fees except for qualifying exemptions by MSD as deemed by Idaho Code and Statues. The flat per gallon price will remain the same price throughout the entire contract term. The vendor also agrees to provide tanks at no cost to MSD. Installation and removal of such tanks will be at no cost to MSD. (A completed RFP has been included for reference.)

Further, the Vendor agrees to provide a 1000-gallon tank, pump with meter and tank monitor AND a 500-gallon tank with meter and tank monitor. The tanks are provided as part of the agreement and MSD will NOT be charged a monthly rental fee. Installation and removal costs are the responsibility of the Vendor. (A completed RFP response has been included for reference.)
