Effect of Article. In the event that the provisions of this Article conflict with any other provision(s) of this Agreement, the provisions of this Article shall prevail.

Effect of Article a) The following provisions shall apply to the administrative investigation of alleged misconduct by APD Police Officers and the process of administrative discipline. To the extent of any conflict between this AGREEMENT and the provisions of Chapter 143 of the Texas Local Government Code, the provisions of this AGREEMENT shall control. To the extent of any conflict between this Article and any other provision of this AGREEMENT, this Article shall control. b) To be considered by the CITY as a basis for investigation and/or discipline, there must be a complaint as defined in this Article and Article 16.

Effect of Article. Employees whose conduct does not conform to the rules and guidelines contained in this Article may be subject to disciplinary action, up to and including termination. Any disciplinary action taken will conform to Civil Service law and/or the provisions of the Collective Bargaining Agreement.

Effect of Article. If the Plan becomes a Top Heavy Plan in any Plan Year, the provisions of this Article VII will supersede any conflicting provision in the Plan.

Effect of Article. The Disciplinary Procedure herein shall prevail over any and all District policy and or practice pursuant to disciplinary action imposed upon a Bargaining Unit Member. The only exceptions shall be that if any law, rule, and/or regulation provides a Bargaining Unit Member subject to disciplinary action more rights and/or regulations provided herein, then such law, rule, and/or regulation shall prevail and shall be considered to be a part of this Agreement.

Effect of Article. The following provisions of this Article XXI and the appropriate provisions of the Trust Agreement shall apply notwithstanding any other provisions of the Plan or the Trust Agreement to the contrary, in the event the Trustee executes a Promissory Note for an exempt loan to the Trust as defined in the regulations under Section 4975(e)(7) of the Code.

Effect of Article. Any purported Transfer of Partnership Interest consummated in violation of this Article shall be null and void and of no force or effect. Any transferee acquiring an interest in the Partnership shall acquire the same subject to all the terms and provisions of this Agreement.

To the extent of any conflict between this AGREEMENT and the provisions of Chapter 143 of the TLGC the provisions of this AGREEMENT shall control. To the extent of any conflict between this Article and any other provision of this AGREEMENT, this Article shall control. Without waiving either party’s legal arguments related to TLGC 143.312, the Parties agree that the provisions of this Article shall not preempt TLGC 143.312 except as explicitly stated herein and in Article 17 of this Agreement. b) To be considered by the CITY as a basis for investigation and/or discipline, there must be a complaint as defined in this Article.
