EFFECTIVE DATE AND LENGTH OF AGREEMENT. This Agreement will become effective on August 1, 2023. The duration of this Agreement is for the period of August 1, 2023 through July 31, 2026. This Agreement may be extended by mutual agreement upon the same terms and conditions for an additional one (1) year term. The Parties may exercise up to two one-year extensions. Any extension of this Agreement must be approved in writing by the City Manager.

The duration of this Agreement is for the period from the Effective Date through June 30, 2024 (“Term”), unless terminated earlier as provided herein. Completion dates or time durations for specific portions of the project are set forth in the Scope of Services and Payment, attached hereto as Exhibit “A” and incorporated herein by reference. This Agreement may be extended, upon the same terms and conditions, for three (3) additional one (1) year terms, only by a document in writing executed by both Parties.
EFFECTIVE DATE AND LENGTH OF AGREEMENT. This Agreement shall enter into force and effect on the day and year of the latest signature and shall continue in effect for a ten (10) year period (“Term”). Neither Party shall have the ability to terminate the Agreement except as otherwise provided in this Agreement during the first (5) years of the ten (10) year Term. Thereafter, either Party may terminate this Agreement in accordance with the terms contained in this Agreement, and Rocket Lab shall be able to terminate this Agreement for convenience with ninety (90) days written notice to VCFSA. Termination of the NASA Agreement, for any reason, shall terminate this Agreement. Any extension of the Agreement beyond the Term shall be subject to mutual agreement of the Parties.
