Extension of this Agreement. The Department may, at its sole option, offer the Provider an extension of the Initial Agreement Term for one or more periods up to an additional maximum of 10 years by giving Notice to the Provider not less than 60 Business Days prior to the end of the then current Agreement Term. Subject to clause 62 [Transition out], if the Provider accepts the Department's offer to extend the Agreement Term, the Agreement Term will be so extended and all terms and conditions of this Agreement continue to apply, unless otherwise agreed in writing between the Parties.
Extension of this Agreement. 3.7.1 This Licence Agreement will commence on the date as set out on page 1, and unless agreed in writing will end automatically on the date as set out on page 1. Agreement to extend your stay beyond the date set out on page 1 will be subject to: • A request to do so being made to the Home Manger in advance of the end date, • Charges for the extended period being paid in full before the start of the extended period, • Confirmation in writing being given by the Organisation as to the period of extension and the rate, per night, to be charged.
3.7.2 Requests to extend an agreed period of respite care which will take the total length of your stay in the Home beyond a period of six weeks from the commencement date set out on page 1 will also require the prior approval of the Head of Care Operations.

If no Operative Date shall have occurred on or before the 365th calendar day preceding the date on which the Term is then scheduled to expire, then the Term shall automatically be extended for one year unless either party shall have given the other party written notice of its election not to extend the Term; provided, that an election by the Company not to extend the Term shall be void ab initio if, at the time of such election, the Company is a party to an agreement providing for a transaction or transactions that, if consummated, would constitute a Change in Control.

(a) No later than three (3) months prior to the Expiry Date, either Party may by notice to the other request the extension of this Agreement, following which the Parties shall meet and seek to agree in good faith the terms for any such extension of this Agreement for up to a further five (5) years.
(b) If the Parties are not able to agree on any such extension of this Agreement by the Expiry Date, this Agreement shall terminate with immediate effect on the Expiry Date.

Extension of this Agreement. 3.1 If the Minister proposes to the Service Provider in writing that the term of this Service Agreement is to be extended, the term shall be extended for one further year or such lesser period as agreed in writing by the Parties.
3.2 Either Party may initiate negotiations with a view to entering into a new Service Agreement for the provision of the Services, or substantially similar services, to come into effect immediately following the Expiry Date. Should either Party intend not to enter into such negotiations, the Party so intending shall advise the other Party in writing of this intention no less than three months prior to the Expiry Date.
3.2.1 Should the Minister not give such advice, the Service Provider shall receive funding at the per annum rate(s) specified in this Agreement for a period of three months following the Expiry Date, to enable the Services to be terminated appropriately.
3.2.2 Should the Service Provider not give such advice, the Minister may take such action as is seen fit to discharge the Minister’s responsibility for the health, social well-being and quality of life of South Australians through the efficient and effective provision of human services.
