Effectiveness of City Council Action. The City's Ordinance No. approving this Agreement, shall have become effective pursuant to California law on or prior to the effective date of this Agreement.
Effectiveness of City Council Action. The City Council’s action approving the form of this 331 Agreement shall have become effective and all Parties shall have signed the Agreement pursuant 332 to Applicable Law prior to or on the Effective Date, provided that no restraining order of any kind 333 has been issued.

Effectiveness of City Council Action. Except as set forth in Article 17, the City Council’s Resolution approving this Agreement shall have become effective pursuant to California law. If a referendum petition or legal challenge to the award of this Agreement is submitted or filed, CONTRACTOR shall defend, indemnify, and hold CITY harmless for all costs incurred to defend such challenge. CONTRACTOR shall further reimburse CITY for any costs incurred in any election subject to this Section.
