CONTRACTOR’S INVESTIGATION. Contractor acknowledges that this Agreement replaces an existing franchise agreement that was executed on February 21, 1995, and amended on April 6, 2006, and that this Agreement is dissimilar to the agreement it is replacing in many respects. Contractor, after making an independent investigation, is satisfied with the conditions and circumstances surrounding this Agreement and the work to be performed by Contractor, and, after taking all such matters into consideration, agrees to provide the services required by this Agreement, for the Compensation delineated within.

CONTRACTOR’S INVESTIGATION. 124 Contractor has made an independent investigation and analysis, the results of which are 125 satisfactory to Contractor, of the conditions and circumstances surrounding the 126 Agreement, its content and preparation, and the work to be performed by Contractor 127 under the Agreement. The Agreement accurately and fairly represents the intentions of 128 Contractor, and Contractor enters into this Agreement on the basis of that independent 129 investigation and analysis.

Contractor has also had the opportunity to review audited financial statements of 21 the current operator of the Shoreway Center. Contractor has taken such matters into 22 consideration in agreeing to provide the services required by, for the compensation to be 23 provided under, this Agreement.

CONTRACTOR’S INVESTIGATION. The Contractor has made an independent investigation (satisfactory to it) of the conditions and circumstances surrounding the Agreement and the work to be performed by it, including the number and type of Waste Generators in the City, the nature of the Solid Waste generated, and the number and location of litter containers to be serviced under Section 5.06. Contractor recognizes that the information provided by the City in the Request for Proposals and in Addenda Nos. 1, 2, and 3 to the Request for Proposals, all of which have been carefully reviewed by Contractor, was provided for the convenience of prospective contractors and, while the City believes it to be correct, the City has made and makes no representations or warranties of any kind with respect to its accuracy or completeness.
