Effectiveness of Service. Notices shall be effective: (a) in the case of personal delivery, when received by the recipient; or in the case of transmission by electronic mail, if receipt of the transmission occurs before [time] recipient’s time and recipient receives a transmission confirmation or otherwise acknowledges transmission, upon receipt of transmission, or if receipt of the electronic mail occurs after [ ] recipient’s time and recipient receives a transmission confirmation or otherwise acknowledges transmission, the next Business Day.

  • Availability of Services CBT agrees not to discontinue or refuse to provide any service provided or required hereunder other than in accordance with the terms of this Agreement, or unless required by the Commission.
