ELECTRONIC FUNDS TRANSFER DISCLOSURE. REGULATION E For purposes of this disclosure the terms “we”, “us” and “our” refer to THE FARMERS AND MECHANICS BANK. The terms “you” and “your” refer to the recipient of this disclosure. The Electronic Fund Transfer Act and Regulation E require institutions to provide certain information to customers regarding electronic fund transfers (EFTs). This disclosure applies to any EFT service you receive from us related to an account established primarily for personal, family or household purposes. Examples of EFT services include direct deposits to your account, automatic regular payments made from your account to a third party and one-time electronic payments from your account using information from your check to pay for purchases or to pay bills. This disclosure also applies to the use of your ATM card or debit card at automated teller machines (ATMs) and any networks described below. This disclosure contains important information about your use of electronic fund transfer (EFT) services provided by THE FARMERS AND MECHANICS BANK in relation to account established primarily for person, family or household purposes. Please read this document carefully and retain it for future reference. ELECTRONIC FUND TRANSFER SERVICES PROVIDED SERVICES PROVIDED THROUGH THE USE OF ATM CARD OR DEBIT CARD. If you have received an electronic fund transfer card (“ATM CARD” or “DEBIT CARD”) from us, you may use it for the type(s) of services noted below, and the following provisions are applicable: USING YOUR CARD AND PERSONAL IDENTIFICATION NUMBER (“PIN”). In order to assist in maintaining the security of your account and the terminals, the ATM card or debit card remains our property and may be revoked or canceled at any time without giving you prior notice. You agree not to use your ATM card or debit card for a transaction that would cause your account balance to go below zero, or to access an account that is no longer available or lacks sufficient funds to complete the transaction, including any available line of credit. We will not be required to complete any such transaction, but if we do, we may at our sole discretion, charge or credit the transaction to another account; you agree to pay us the amount of the improper withdrawal or transfer upon request. Your ATM Card may only be used with your PIN. Certain transactions involving your debit card require use of your PIN. Your PIN is used to identify you as an authorized user. ELECTRONIC FUNDS TRANSFER DISCLOSURE. Consumer Liability for Unauthorized EFTs Notify us immediately if you believe your Online Banking or Mobile Banking ID or password has been lost or stolen, or if you believe an EFT has been made without your permission. Contacting us by telephone is the best way of minimizing your possible losses. You could lose all the money in your Account(s), plus your maximum overdraft line of credit, if any. If you notify us within 2 Business Days after you learn of the loss or theft of your Online Banking or Mobile Banking ID or password, your liability will not exceed $50, if someone uses your Online Banking or Mobile Banking ID or password without your permission. If you fail to notify us within 2 Business Days after learning of the loss or theft of your Online Banking or Mobile Banking ID or password and we establish that these EFTs would not have occurred had you notified us within that 2-day period, your liability will not exceed $500. You must report an unauthorized EFT that appears on a periodic statement within 60 days of our transmittal of the statement to avoid liability for subsequent transfers. If you fail to do so, your liability will not exceed the amount of the unauthorized EFTs that occur after the close of the 60 days and before notice to us, and that we establish would not have occurred had you notified us within the 60-day period. If your delay in notifying us was due to extenuating circumstances, we may, at our option extend the times specified in the immediately preceding paragraphs to a reasonable period. Unless you have been grossly negligent or have engaged in fraud, you will not be liable for any unauthorized transactions using your lost or stolen MasterCard debit card. This additional limit on liability does not apply to ATM transactions or to transactions using your Personal Identification Number (“PIN”) which are not processed by MasterCard. ELECTRONIC FUNDS TRANSFER DISCLOSURE. You may arrange for direct deposits to be made to, automated payments to be paid from, and funds to be transferred between your Accounts with us, subject to any restrictions and limitations set forth in this Agreement. Because your Account was established primarily for personal, family or household purposes, these transactions are governed by Regulation E and the following special provisions and disclosures apply. When you accept direct deposits or authorize automated payments/debits or telephone transfers to or from your Account, you agree to these terms and conditions. These terms and conditions are in addition to those contained elsewhere in this Agreement, provided those terms and conditions are not inconsistent with Regulation E.

Please see the “Electronic Funds Transfer Disclosure” at the end of this Part 2 of the BSA. Enter. The words “enter,” “entered,” “entering,” “note,” “noted,” “noting,” “reflect,” “reflected” and “reflecting” mean that we (or you, as we allow) type, input or write your information in documents or our computer system that pertains to your actions and transactions on our products and services, which becomes part of and is re- tained in our records. Fee. The words “fee” and “charge,” and the phrase “service charge,” mean an amount of money we require you to pay to par- tially cover the expense of when you use or incur a service with us. ELECTRONIC FUNDS TRANSFER DISCLOSURE. The provisions of the following Electronic Fund Transfer Disclosure apply only to electronic fund transfers to or from accounts established primarily for personal, family, or household purposes (“consumer accounts”). These provisions do not apply to any transactions that are not covered under the Electronic Fund Transfer Act or Regulation E. This Electronic Fund Transfer Disclosure governs your use of electronic funds transfer services, including telephone transfer service through our 24-hour Automated Customer Service Department, and preauthorized transfers (as applicable). Additional, separate terms and disclosures will govern the use of other electronic funds transfer services, including the Tri Counties Bank automated teller machine card (“ATM Card”), and the Visa® Debit card (“Debit card”), which are together referred to hereafter as “Card”.
