Automated Teller Machine. (S); NIGHT DEPOSITORY(IES). Tenant shall have at all times during the Term and Renewals thereof, the right to install and maintain at its expense an automated teller machine(s) ("ATM(S)") and night depository(ies) within the Premises or other portion of the Project accessible at all times by the public, and visible to the exterior of the Building at no additional rental charge. Landlord agrees that during the Term, including any Renewal Term(s), Landlord shall not lease, or permit the installation of, any other ATM(s) and night depository(ies), by any party other than the Tenant in any portion of the Building or Project. The location, appearance and lighting of the ATM(s) and night depository(ies) shall be mutually agreed upon by Tenant and Landlord, which such agreement shall not be unreasonably withheld, conditioned or delayed. At the expiration or earlier termination of the Lease, Tenant, at its expense, shall remove the ATM(s) and/or night depository(ies). Any work required to restore the Building from any damage occasioned by the installation, maintenance, relocation or removal of the ATM(s) and/or night depository(ies) shall be borne by Tenant. Tenant shall indemnify and hold harmless Landlord from all costs, damages, expenses, liabilities, and suits, including reasonable attorneys' fees, occasioned by Tenant's installation, maintenance, relocation, removal or use of the ATM(s) and/or night depository(ies), including without limitation, any damage to Property and/or injury or death to persons caused thereby from the installation, maintenance, and operation. Notwithstanding the foregoing, the Landlord is responsible for maintenance of lighting, landscaping and access to, from and around the ATM(s) and the Landlord shall at all times comply with the requirements of Sections 655.960 through 655.965 of Florida Statutes (1993) inclusive and shall indemnify and hold harmless the Tenant from all costs, damages, expenses, liabilities, and suits, including reasonable attorneys' fees, including without limitation, any damage to Property and/or injury or death to persons caused by the Landlord failure to comply with said Statutes, unless the loss resulted from modifications to the ATM made by Tenant.
Automated Teller Machine. Tenant shall have the right to install one (1) ATM and night depository in the Premises (collectively referred to herein as (“ATM”). The location, plans and specifications for the ATM (including the identifying signage) shall be subject to the prior written approval of Landlord and are affixed hereto as Exhibit G. Tenant shall be solely responsible for the cost of installation of the ATM, together with all maintenance and repairs of the ATM and related equipment, cables and conduits. Tenant shall also be responsible for all security pertaining to the ATM, and shall operate same in accordance with all applicable laws and regulations. Tenant shall ensure that the ATM remains properly lighted during evening hours utilizing lighting fixtures approved by Landlord. Tenant shall indemnify, defend and hold Landlord harmless from any liability, loss or expense resulting from the operation of the ATM in accordance with the provisions of Section 10.3 of the Lease. Any alterations to the ATM shall be subject to Landlord’s prior written approval and the provisions of Section 7.3 of this Lease. Promptly following the termination of this Lease, Tenant shall remove the ATM and restore the affected area of the Building to its pre-existing condition, wear and tear excepted.
Automated Teller Machine. When using our Automated Teller Machines (ATM), you may use your access card (card) to:
Automated Teller Machine. “ATM”) Transactions. You may use your Visa® Debit Card (not applicable for HSA accounts) to access your account at an ATM as follows: • You may withdraw up to $1,000.00 per day. • You may make deposits to your accounts at certain Affinity Plus ATMs. • ATM transactions post to your account immediately. However, there is a 48 hour hold on deposits. • Any ATM fees are subject to the terms and conditions of your Affinity Plus account.
Automated Teller Machine. Lessor authorizes Lessee to construct and install one Automated Teller Machine (ATM) on the ground floor of the Building, also Lessee may install an ATM within the Premises, both to be at a location subject to the approval of Lessor and if required the City of El Segundo. The construction and installation of such ATM's shall be deemed an Alteration and is subject to the terms of Article 7 hereof. No other person or entity shall be permitted to construct or install an ATM in the Building provided Lessee proceeds to construct and install such ATMs within twelve (12) months from and after the Commencement Date and thereafter maintains such ATMs in active use. Failure of Lessee to meet these conditions shall permit Lessor to allow another entity to construct and install an ATM in or around the Building.
Automated Teller Machine. (ATM) Deposits. When you make a deposit in an ATM, funds from deposit of US Treasury checks that are payable to you and checks drawn on GTE Financial will be available on the first business day after the day of your deposit. For other check deposits made at a GTE Financial ATM, the first $225 of the deposit will be available by the next business day with the balance of the ATM deposit fully available no later than the second business day after the deposit is made. If you make a deposit at an ATM that we own or operate before 6:30 p.m. on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit at an ATM that we own or operate after 6:30 p.m. or on a day we are not open, we will consider that the deposit was made on the next business day we are open. For deposits made at an ATM not operated by GTE Financial, the balance of the ATM deposit will be fully available no later than the fifth business day after the deposit is made. For determining the availability of your ATM deposits, every day is a business day except Saturdays, Sundays, and federal holidays.
Automated Teller Machine. This agreement (the “Agreement”) dated , 2003, is made by and between METROPOLITAN LIFE INSURANCE COMPANY, a New York corporation (“Licensor”), and SOUTH BAY BANK, a (“Licensee”).
