Employer considerations. The dental practice generally wants the non-compete clause to have a longer length of time and a larger geographic area. The length of time is limited to one year in the state of Utah, but other states do not have such limitations. The dental practice should be conscience that the practice of dentistry is built on the relationship between the dentist and the patient. If the associate dentist has strong relationships with his patients, then his patients will be tempted to follow the associate dentist to a different practice. Accordingly, the geographic area should be large enough so that it is impractical for patients to follow the associate dentist to a new location.

Employer considerations. If the dental practice is worried about enforcing non- compete covenants or non-solicitation covenants, then litigation is not recommended because the dental practice will suffer damages during litigation (which will be a long time).
