ENERGY EFFICIENCY IN ENERGY-CONSUMING PRODUCTS. (DEC 2007) Definition. As used in this clause­ "Energy-efficient product"- Means a product that- Meets Department of Energy and Environmental Protection Agency criteria for use of the Energy Star trademark label; or Is in the upper 25 percent of efficiency for all similar products as designated by the Department of Energy's Federal Energy Management Program. The term "product" does not include any energy-consuming product or system designed or procured for combat or combat-related missions (42 U.S.C. 8259b) The Contractor shall ensure that energy-consuming products are energy efficient products (i.e., ENERGY STAR® products or FEMP-designated products) at the time of contract award, for products that are- Delivered; Acquired by the Contractor for use in performing services at a Federally-controlled facility; Furnished by the Contractor for use by the Government; or Specified in the design of a building or work, or incorporated during its construction, renovation, or maintenance. The requirements of paragraph b. apply to the Contractor (including any subcontractor) unless- The energy-consuming product is not listed in the ENERGY STAR® Program or FEMP; or Otherwise approved in writing by the Contracting Officer. The Seller agrees to comply with FAR 52.223-15 – Energy Efficiency in Energy-Consuming Products.and FAR 52.223-16 – Acquisition of EPEAT®-Registered Personal Computer Xxxxxxxx.xx they apply to the products being requested by the Government or Authorized Subcontractor. Whenever possible, the Dell information technology systems (IT Systems) (e.g., notebooks, desktops, workstations, servers, data storage equipment, etc.) offered under ICPT BOA # 4I-31841 will comply with the Trade Agreements Act (TAA) as specified in FAR 52.225-5. In the event a Dell IT System or standalone peripheral item requested by the Government or DOE Contractor does NOT comply with the TAA, it will be disclosed on the Dell quote provided by being labeled as “NON-TAA.”

  • Electric Storage Resources Developer interconnecting an electric storage resource shall establish an operating range in Appendix C of its LGIA that specifies a minimum state of charge and a maximum state of charge between which the electric storage resource will be required to provide primary frequency response consistent with the conditions set forth in Articles 9.5.5, 9.5.5.1, 9.5.5.2, and 9.5.5.3 of this Agreement. Appendix C shall specify whether the operating range is static or dynamic, and shall consider (1) the expected magnitude of frequency deviations in the interconnection; (2) the expected duration that system frequency will remain outside of the deadband parameter in the interconnection; (3) the expected incidence of frequency deviations outside of the deadband parameter in the interconnection; (4) the physical capabilities of the electric storage resource; (5) operational limitations of the electric storage resources due to manufacturer specification; and (6) any other relevant factors agreed to by the NYISO, Connecting Transmission Owner, and Developer. If the operating range is dynamic, then Appendix C must establish how frequently the operating range will be reevaluated and the factors that may be considered during its reevaluation. Developer’s electric storage resource is required to provide timely and sustained primary frequency response consistent with Article 9.5.5.2 of this Agreement when it is online and dispatched to inject electricity to the New York State Transmission System and/or receive electricity from the New York State Transmission System. This excludes circumstances when the electric storage resource is not dispatched to inject electricity to the New York State Transmission System and/or dispatched to receive electricity from the New York State Transmission System. If Developer’s electric storage resource is charging at the time of a frequency deviation outside of its deadband parameter, it is to increase (for over-frequency deviations) or decrease (for under-frequency deviations) the rate at which it is charging in accordance with its droop parameter. Developer’s electric storage resource is not required to change from charging to discharging, or vice versa, unless the response necessitated by the droop and deadband settings requires it to do so and it is technically capable of making such a transition.
