Ensuring Compliance with Management Policies. 25 The City shall monitor its Subrecipients and Owners 26 and require that its Subrecipients and Owners comply with the 27 applicable requirements of Section 504 and applicable HUD 28 regulations, the ADA and applicable HUD regulations, California 1 Accessibility Standards, and this Agreement in designing, 2 constructing, altering, operating, administering, and financing 3 housing. Failure or refusal of a Subrecipient or Owner to comply with 4 the Accessibility Standards and applicable provisions of this 5 Agreement may result in progressive steps by the City to compel 6 compliance such as declaring an event of default under active loan 7 agreements, suing for breach of loan or covenant agreements with 8 demand for specific performance and damages, negative evaluations 9 and reduction in rating factor points for future project consideration 10 through existing contractor evaluation and contractor responsibility 11 ordinances, or debarment proceedings or the filing of a complaint or 12 referral to HUD for further enforcement actions.
