Evacuation of Facilities. Should it become necessary, in the judgment of TAMU-CC, to evacuate the Premises for any reason of public safety, evacuation will be accomplished under exclusive control of TAMU-CC. Customer may, following evacuation, reestablish use of the Premises for sufficient time to complete presentation of its event without additional charges being incurred, provided such time does not interfere with use of the Premises by another scheduled event. If it is not possible to complete presentation of your event, all fees shall be forfeited, prorated, or adjusted at the discretion of TAMU-CC. Customer waives any claim for damages or compensation from TAMU-CC.

Evacuation of Facilities. Should it become necessary, in the sole judgment of Licensor, to evacuate the Center for any reason, evacuation shall be accomplished under the exclusive control of Licensor. Licensee may, following an evacuation, reestablish its use of the Center for sufficient time to complete presentation of Licensee’s Event without incurring any additional Use Fee; provided that completing Licensee’s Event does not interfere with use of the Center under a reservation by another licensee. If it is not possible to complete presentation of Licensee’s Event, then all fees paid by Licensee may be prorated, or adjusted at the discretion of Licensor. By signing this Agreement, Licensee waives any claim of damages or compensation from Licensor resulting from an evacuation of the Center.

Evacuation of Facilities. UTRGV is primarily responsible for determining whether public safety requires the cessation of the Event and/or the evacuation of the Facility; provided that any such evacuation will be accomplished under the control of UTRGV. User may, following evacuation and with the consent of UTRGV, resume use of the Facility for sufficient time to complete the presentation of its activity without additional Facility Use Fees provided such time does not interfere with use of the Facility by another User or UTRGV. If it is not possible to complete presentation of the Event, the fees and charges payable by User hereunder shall be adjusted as deemed equitable by UTRGV in its sole discretion. User waives any claim for damages or compensation from UTRGV in connection with this Section.

  • Inspection of Facilities In order to meet their respective obligations under this Agreement, any Party may view or inspect facilities owned by another Party. Provided that reasonable notice is given, a Party shall not unreasonably deny access to relevant facilities for viewing or inspection by the requesting Party.
