Exclusive Procedure for Resolving Disputes. This Section 19 (Dispute Resolution) sets forth the sole procedures for resolving any Dispute between the Parties, and neither Party may commence or maintain any suit or legal or equitable proceeding concerning a Dispute hereunder until the Dispute has been determined in accordance with the arbitration procedure provided for herein, and then only to enforce or facilitate the execution of the award rendered in such arbitration. The Parties agree to waive, to the maximum extent permitted by Legal Requirements, the right of appeal to a court of law.

Exclusive Procedure for Resolving Disputes. The provisions of this SECTION 11 shall apply to any claim, controversy or dispute between any one or more of the HCC Parties, on the one hand, and either or both of the Public Parties, on the other, relating to this Agreement or the subject matter hereof. As used in this Section, (a) the termAggrieved Parties” means the Parties delivering the Notice of Default, and (b) the term “Responding Parties” means the Parties alleged to be in breach in the Notice of Default. No Party may deviate from the procedures set forth in this SECTION 11; provided that nothing prevents representatives of the Parties from engaging in informal discussions among themselves during the pendency of the procedures described in this SECTION 11 to attempt to resolve the dispute.

  • Commencing Dispute Resolution 13.3.1 Dispute Resolution shall commence upon one Party’s receipt of written Notice of a controversy or claim arising out of or relating to this Agreement or its breach.
