Common use of Expenses of Arbitration Clause in Contracts

Expenses of Arbitration. Each party will pay its own expenses for participation in such arbitration, including the fees and expenses of such party’s legal counsel and other advisors, provided that the Company will pay all fees and expenses of the arbitrators and any fees or charges imposed by the arbitral body for such arbitration, provided that the arbitral body shall have authority to require you to pay fees or charges if you initiate the arbitration and it determines that your claims are frivolous or without merit.

Expenses of Arbitration. Expenses of Arbitration. (1) Each party will shall pay its own expenses for participation in connection with any such arbitrationarbitration proceedings. Such expenses shall include, including but not by way of limitation, the fees compensation and expenses of such party’s legal counsel and other advisorsexpenses, provided that the Company will pay all fees and expenses if any, of the arbitrators arbitrator appointed by such parties and any fees or charges imposed by of all persons appearing before the arbitral body for such arbitration, provided that the arbitral body shall have authority to require you to pay fees or charges if you initiate the arbitration and it determines that your claims are frivolous or without meritarbitrator in its behalf.

If one party chooses two of the arbitrators, including as above provided, the fees and expenses expense of such party’s legal counsel and other advisors, provided that the Company will pay all fees and expenses of the arbitrators and any fees or charges imposed by the arbitral body for such arbitration, provided that the arbitral body shall have authority to require you to pay fees or charges if you initiate the arbitration and it determines that your claims are frivolous or without meritwill be equally divided between the two parties.
