EXPORT AND IMPORT LICENSES. 16.1 The Supplier is responsible to timely apply for, obtain, and secure any Export Control License, in the territory of the Supplier and its sub-contractors, required to enable the timely delivery and discharging of all its obligations under this Agreement. The Supplier shall also support the Buyer in connection with any future retransfer of the Product or part thereof.
EXPORT AND IMPORT LICENSES. BUYER shall be responsible for correct export control classification of products, components, technology or software, whether as is or embedded into other equipment. BUYER further agrees to comply with applicable export, re-export or end-use restrictions, and to obtain any licenses or other official authorizations that may be required by the country of importation and/or under the Export Administration Regulations, International Traffic in Arms Regulations, or other applicable laws or regulations from all applicable jurisdictions.

(a) If any export license or any other governmental authorization is required for the export of Goods, it shall be the obligation of the Contractor to obtain any such license or governmental authorization. Subject to and without waiver of its privileges and immunities as an intergovernmental organization, IDLO may to the extent possible facilitate the provision of such license or governmental authorization. In the event of failure to obtain such a license or authorization within a reasonable time, IDLO may declare the Contract or a particular Contract for Goods (Purchase Order) or Work Order invalid.

Illumina will, at its own cost, obtain any and all permits, approvals and licenses required for its export of the Supplied Products from the point of manufacture/distribution, and CareDx will, at its own cost, obtain any and all permits, approvals and licenses required for its importation of the Supplied Products.

EXPORT AND IMPORT LICENSES. All technical data, services and products, delivered by a party to the other in connection with this Agreement are subject to U.S. export laws and may be subject to the trade laws of other countries. Each party agrees to comply with all such laws. Unless authorized by the U.S. Government, each party will not export or re-export such items to entities on the most current U.S. export exclusion lists or to any embargoed or restricted destinations as specified in the U.S. export laws. The owner of the Product shall be exporter of record under U.S. export control laws and shall be responsible for securing an export license if a Product is subject to export control and export is outside the U.S. Supplier shall provide all information under its control which is necessary or useful for Sun to obtain any export or import licenses required for Sun to ship or receive Products, including, but not limited to, U.S. Customs Certificates of Delivery, Certificates of Origin, U.S. Federal Communications Commissions ("FCC") identifier, and DHHS (Bureau of Radiologic Health, FDA) Accession Number, if applicable. When requested by Sun, Supplier shall use commercially reasonable efforts to provide the following Import-related documentation to Sun by certified mail within fifteen (15) days after shipment of Product to Sun: (i) Manufacturer's Certificate of Origin and FCC identifier, DHHS/FDA Accession Number to permit Sun to import Product; (ii) U.S. Customs Certificates of Delivery, attention: Sun's Import Administration Department, Sun Microsystems, Inc., 000 Xxx Xxxxxxx Xxxx, X/X XXXX00-000, Xxxx Xxxx, XX 00000, Ph: (000) 000-0000, Fax: (000) 000-0000. 26 SUPPLIER INSURANCE POLICIES. Supplier insurance obligations to Sun are set forth in Exhibit H.
