FACILITY RESPONSIBILITIES. (1) The Facility will retain responsibility for the care of its clients and will maintain administrative and professional supervision of students insofar as their presence and program assignments affect the operation of the Facility and its care, direct and indirect, of its clients. If faculty participation at the Facility other than as a Supervisor for the purpose of this ALE is so authorized, it must not be a substitute for adequate staffing at the Facility. If the ALE involves exposure to bloodborne pathogens, Facility shall provide participants with education regarding bloodborne pathogens appropriate to the participant's educational training at Facility, and, shall maintain documentation of such education. University shall, to the extent allowed by law or regulation, offer to participants at substantial risk of directly contacting body fluids, antibody and or antigen testing and vaccination in accordance with requirements of the Occupational Health and Safety Administration and Centers for Disease Control. Facility will use its best efforts to appropriately test the source patient and to obtain that patient's consent to disclosure of test results to the University and participant.

(3) The Facility will use its best efforts to make conference space bylaws, rules, and classrooms available regulations of the Institution as may be necessary in effect from time to time. (4) Facility staff shallthe assigned Student. The Student will otherwise be responsible for his or her own health care, upon request, assist including maintaining his or her own medical insurance. Assist the University Institution in the evaluation review of Students, including advising the Institution of any serious deficiency noted in the ability of an assigned Student to progress toward achievement of the learning and performance stated objectives of participating students, provided the student has signed a consent to exchange Training. The nature and scope of activities of University faculty members that may involve in any way patient care at the Facility shall be subject to the sole discretion of the Facility and to such conditions as the Facility may deem necessary in its sole discretion including, but not limited to, prior proof of professional liability coverage, appropriate licensure or certification, and compliance with all Facility rules, regulations, and policies. If faculty participation at the Facility other than as a Supervisor for the purpose of this ALE is so authorized, it must not be a substitute for adequate staffing at the Facility.
(7) All medical or health care (emergency or otherwise) that a an Institution student or University faculty member receives at the Facility will be at the expense of the individual involved.
(8) Facility agrees to inform the University and its students of the specifics of Facility's requirements with regard to background check and drug screening procedures prior to commencement of their ALE.
(9) Facility and University acknowledge that protection of participants in the ALE from exposure to bloodborne pathogens is the joint concern of Facility, University and the participant. Facility will make available to participants for use within the Facility all personal protective equipment, including gloves, gowns, masks, and other supplies necessary to comply with Centers for Disease Control guidelines, as appropriate to the participant's ALE. If the ALE involves exposure to bloodborne pathogens, Facility shall provide participants with education regarding bloodborne pathogens appropriate to the participant's educational training at Facility, and, shall maintain documentation of such education. University shall, to the extent allowed by law or regulation, offer to participants at substantial risk of directly contacting body fluids, antibody and or antigen testing and vaccination in accordance with requirements of the Occupational Health and Safety Administration and Centers for Disease Control. Facility will use its best efforts to appropriately test the source patient and to obtain that patient's consent to disclosure of test results to the University and participant.

FACILITY RESPONSIBILITIES. A. The Facility shall have the exclusive right to determine the renumber of Students, if any which the Facility will accept into the program.
B. The Facility shall assign a staff member to serve as the Facility clinical coordinator to whom the University's Clinical Program Coordinator shall report. It is understood by the parties that the Facility may have a different clinical coordinator for each of the programs listed in section I. The clinical coordinator may not be a full time position and the Facility shall determine, in its sole discretion, the amount of time the clinical coordinator shall devote to the responsibilities set forth herein. The clinical coordinator shall be responsible for:
(1) Planning and coordinating the clinical education arrangements between the Facility and the University;
(2) Serving as a liaison between the Facility and the University; and
(3) Developing and administering an orientation program for new Students which will familiarize the Students with the Facility, and all applicable policies and procedures.
C. A Student shall not be used in lieu of professional or non-professional staff of the Facility, and the Students shall at all times be supervised by a qualified member of the Facility staff or by the Students' clinical instructor as appropriate during their participation in the clinical educational program.
D. The Facility will agrees to retain complete responsibility for the care of its clients and will maintain administrative and professional supervision of students insofar as their presence and program assignments affect the operation of the Facility and its care, direct and indirect, of its clients. No provision of this MOU shall prevent any Facility client from requesting not to be a teaching client or prevent any member of the Facility’s staff from designating any client as a non-teaching clientpatients.
(2) E. The Facility will shall provide adequate clinical facilities education learning experiences for participating students the Students which are planned, organized, and administered by qualified staff in accordance with mutually agreed upon ·educational objectives and guidelines
F. The Facility reserves the objectives developed through cooperative planning by exclusive right, to be exercised solely with the Facility's discretion, to dismiss at any time any Student for any non- discriminatory reason. The Facility Clinical Coordinator shall promptly notify the University's departmental faculty Clinical Program Coordinator of any problem or difficulty arising with a Student, and a discussion shall be held either by telephone or in person regarding the Student. The Facility will, however, have final responsibility and authority to dismiss any Student from the Clinical Program at the Facility's staff.
(3) G. The Facility will use its best efforts shall upon reasonable request permit representatives of the University to make conference space inspect the . clinical fac.ilities and classrooms services available as may be necessary for teaching · clinical experience, Student records, if any, and planning activities in connection with an ALEother items pertaining to the clinical education program.
(4) Facility staff shall, upon request, assist the University in the evaluation of the learning and performance of participating students, provided the student has signed a consent to exchange of H. FACILITY RESPONSIBILITIES. (1) The . Subject to the provisions of Section C.2 of this Agreement, the Facility agrees to make the appropriate facilities available to the School in order to provide supervised clinical experiences to students. Such facilities shall include an environment conducive to the learning process of the students as intended by the terms of this Agreement and conforming to customary Facility procedures.
2. Students are to remain subject to the authority, policies, and regulations imposed by the School and, during periods of clinical assignment, students will retain responsibility for the care of its clients be subject to all rules and will maintain administrative and professional supervision of students insofar as their presence and program assignments affect the operation regulations of the Facility and imposed by the Facility on its careemployees and agents with regard to following the administrative policies, direct standards, and indirectpractices of the Facility.

4. Emergency outpatient treatment will be available to students while in the hospital for clinical training in case of accident or illness.
