Responsibilities of Facility. Facility shall be responsible for: A. Designating a Facility staff person to liaison between the Facility and OnsiteCare; B. Complying with generally accepted procedures and standards in making referrals to the OnsiteCare, including, without limitation, provision of the following information for each referred patient: (i) name and/or responsible party’s name and contact information; (ii) name and contact information for referring person and attending physician; (iii) medical history and other appropriate medical information available to Facility; (iv) information to facilitate and enable OnsiteCare to obtain appropriate consent for Services; (v) information to facilitate and enable OnsiteCare’s billing of payers for Services; C. Providing a consultation room for private evaluations of patients by the OnsiteCare Providers; D. Providing timely communication in circumstances involving a patient’s emergent medical condition.

Responsibilities of Facility. Facility during the term of this Agreement shall be responsible for: 1. Cooperation with and support of Medical Director in performance of the services agreed to be provided hereunder, including compliance to the best of facilities ability with all federal and state laws and regulations regarding the medical direction. 2. Maintenance of adequate staff, supplies, equipment and facilities to enable Medical Director to adequately assume the responsibilities hereunder taken.
Responsibilities of Facility. (a) For any student assigned to a qualified preceptor, clinical supervisor, or other Facility professional at Facility, upon completion of that student’s clinical experience and training at Facility, the Facility Director will ensure that a written performance evaluation is completed for each student in the form and within the time limits specified by the Affiliating School Director. (b) Facility will provide safe physical facilities and environment needed for clinical instruction of the Affiliating School students, within the reasonable capacity of Facility, subject to its primary responsibility to care for patients. Direct contact between students and patients shall be subject to approval of Facility. (c) Facility will provide adequate orientation for Affiliating School faculty and students prior to the beginning of the students’ assignments. (d) Facility will allow Affiliating School’s students to use Facility conference rooms and comfort facilities such as the cafeteria, lounges and rest rooms, and to provide, on an “as available” basis, lockers and, at a student’s or faculty member’s expense, parking at assigned parking areas. (e) Facility agrees to maintain general liability insurance in the amount of One Million Dollars ($1,000,000.00) per occurrence and Three Million Dollars ($3,000,000.00). Facility shall provide Affiliating School with at least thirty (30) days prior written notice of any change, cancellation or termination of such insurance coverage. Upon request Facility will provide a certificate of insurance to the Affiliating School. (f) Facility will provide, at its customary rate, any emergency medical care required by an Affiliating School student while participating in the Clinical Program at Facility. The cost of such treatment will be the responsibility of the individual student treated. (g) In the event any student is exposed to blood from a patient who is a carrier of a contagious or infectious disease or a patient who is, in the judgment of Facility, at risk of being a carrier of a contagious or infectious disease, Facility will, with the consent of the student, administer immediate precautionary treatment consistent with current medical practice. Initial screening tests or prophylactic medical treatment shall be paid for by the student’s own medical coverage. Responsibilities of Facility. A. To abide by all pertinent rules and regulations of the Department. Delivery of a copy of said rules and regulations to the Applicant shall constitute due notice and knowledge by the Applicant of said rules and regulations. That said rules and regulations contained in the current Handbook for Intermediate Care Facilities for Individuals with an Intellectual Disability prepared and circulated by the Department are made a part of this agreement. Delivery to the Applicant of new, amended, or revised rules and regulations shall constitute due notice thereof, and the Applicant agrees to abide by said rules and regulations. B. To provide diagnosis, treatment, and habilitation of individuals with an intellectual or developmental disability, in a protected residential setting, with individualized, ongoing evaluation, planning, 24 hour supervision, and coordination and integration of health and rehabilitative services to help each individual reach his/her maximum functioning level. C. To accept for payment for supplying the services in “B” above, the Department’s vendor payment now in effect, or as hereafter modified. 1. The Facility will be notified of the amount the resident is to pay on the cost of his/her care. The balance of the allowable payment for care will be paid by the Department directly to the Facility. The total of these amounts shall be accepted as payment in full for the care of the resident, and no additional charges shall be made to the resident or any other source, except as allowed within Medicaid policies and regulations. 2. If the Facility should receive payment for medical services, benefits, and/or goods, in an amount in excess of that permitted by said law, rules, and regulations; that such excessive payments may be deducted from future payments on behalf of residents otherwise payable to said Facility, and/or recovery of such payments may be made otherwise, at the option and discretion of the Department, in accordance with its rules and regulations pertaining to recoveries or other legal means. D. To cooperate with state and federal personnel who make periodic inspections, reviews, and audits. 1. To allow regular medical care reviews of each resident covered under the Medicaid program including an evaluation of the patient’s need for the services the Facility provides. Responsibilities of Facility. Facility shall fulfill the following terms, obligations, and covenants: 2.1. Provide supervised learning experiences providing students the opportunity to observe facility programs to cover learning objectives, skill development areas, learning experiences, and intended learning outcomes. 2.2. Cooperate with College regarding any performance appraisals, student progress, and other functions of the Program. 2.3. Provide an atmosphere for learning that is supportive and free of discrimination based on race, ethnicity, religion, gender, disability, or sexual preference. 2.4. Provide Students with information regarding policies and procedures of Facility, and with orientation experiences to ensure that Students will be able to meet the requirements of Facility.
Responsibilities of Facility. Facility shall: (1) Designate a qualified Facility Liaison and timely inform University of the name, address, email address and phone number of said Facility Liaison who will be available to assist University personnel and Students of the Program. The Facility Liaison will be responsible for maintaining ongoing contact with University’s designated representative and providing instruction and supervision of the Students based in the Facility. (2) Provide facilities necessary to support the Program(s) for the training and qualifying of Students in the Program as identified in the Program Addendum; provide a supervised learning experience for Students in accordance with agreed upon learning objectives, skill development areas, learning experiences, and intended learning outcomes. (3) Provide University’s Program Liaison (or other designee) and Students, as necessary, with periodic performance information and tender a end-of-semester evaluation for Students. (4) Immediately report any unsatisfactory conduct or performance of a Student to the University’s Program Liaison. (5) Permit designated faculty members the right to visit with Students and Facility liaisons/supervisors at Facility regarding the progress of Students participating in the Program at Facility. (6) Provide Students with essential conditions and materials for their work (including safety equipment as necessary), including direct supervision, space, privacy, participation in appropriate activities, access to conference rooms for student education, office space for Program Liaisons, locker rooms or other secure space for faculty and students to store materials while on assignment, access to libraries and cafeteria (subject to any applicable fees or charges as are customarily charged to any other person), technological supports and, reimbursements for work-related expenses, where applicable. (7) Provide an atmosphere for learning that is supportive and free of discrimination based, on race, color, national origin, religion, gender, age, disability, gender identity or sexual preference. (8) Provide Students with information regarding policies and procedures of Facility, and with orientation experiences to ensure that Students will be able to meet the requirement of Facility. Responsibilities of Facility. 2.1. Facility shall designate a Site Coordinator who will be responsible for the planning and implementation of the pharmacy practice experience at Facility. 2.2. Facility shall structure the pharmacy practice experience as needed to meet the objectives of the experiential learning component for professional preparation of student pharmacists. Facility shall attempt to meet the objectives set forth by University within the constraints of Facility physical environment, patient load, and experience available. 2.3. Facility shall ensure that all individuals who are supervising students at Facility are duly appointed as Facility employees and are appropriately credentialed and/or licensed in compliance with any applicable accreditation and/or licensing standards. Facility shall be exclusively responsible for the management, standard, and delivery of care at Facility. 2.4. Facility shall maintain at all times full authority over and responsibility for care of its patients and may intervene and/or redirect students when appropriate or necessary. 2.5. Facility shall advise University of any changes in its personnel, operation, or policies that may affect the pharmacy practice experience. 2.6. Facility shall provide the assigned students, whenever possible, with the use of library resources, reference materials, equipment, and all other items necessary. 2.7. Facility shall provide all participating students with a copy of Facility rules, regulations, policies, and procedures with which the students are expected to comply. Facility shall also provide an orientation of the type and scope provided by Facility to its new employees, including but not limited to safety and security precautions, the handling and disposal of needles and other sharp objects, and Facility’s protocols for on-the-job injuries resulting from needlestick injuries and other exposures to blood or bodily fluids or airborne contaminants. 2.8. Facility shall provide for emergency health care of the student if necessary at the expense of the student. 2.9. Facility shall, upon reasonable request, permit University and/or appropriate agencies charged with the responsibility of accrediting or approving the pharmacy curriculum to inspect its facilities, services available for pharmacy practice experience, student records, and other materials pertaining to the pharmacy practice experience program. 2.10. Responsibilities of Facility. 1.01 Admit and provide palliative inpatient services to Hospice patients, subject to availability of bed and services, twenty-four hours a day, seven days a week, in accordance with the Plan of Care as established, revised and coordinated by the Hospice Interdisciplinary Team. 1.02 Establish policies consistent with Hospice and abide by patient care protocols established by Hospice for its patients. Facility will conform to all applicable policies, including personnel qualifications. 1.03 Ensure that each patient receives treatments and tests, medications, diets, supplies, and equipment as prescribed, and is kept comfortable, clean, and well groomed. Facility will take necessary precautions to protect the patient from accident, injury, and infections. 1.04 Provide services only with the express authorization of hospice. Facility will notify Hospice immediately of any physician orders that are noncompliant with the Plan of care or hospice protocols. 1.05 Provide adequate, qualified personnel that provide safe, effective care under current clinical practice guidelines and professional practice standards, applicable to hospice care. Personnel providing care to hospice patients will meet all state and federal regulations and requirements for licensing and/or certification. Facility is responsible for checking criminal background history on their employees/contracted staff who have direct patient conduct or access to patient records, and for checking the OIG Exclusion List on a monthly basis. 1.06 Ensure each shift has an RN who is available to complete patient/family assessments, provide care, collaborating with the Hospice RN to review patient plan of care, treatments, and medications. 1.07 Notify Hospice for changes in patient condition, patient or family needs, requests for additional tests or services, need for changes in physician orders or pain/symptom management, or requests for hospice staff visits. 1.08 Provide access and unrestricted visiting privileges (including visits by children of all ages) twenty- four (24) hours a day, three hundred and sixty five (365) days a year. 1.09 Provide space for private visiting between patients and their families, and accommodations for family members to remain with the patient throughout the night, and in the event of death, privacy for the family. 1.10 Maintain a medical record that includes all inpatient services and events provided and that includes a designated area/section specifically for hospice documentatio...
Responsibilities of Facility. 3.1. Within ten (10) business days following the end of each calendar month during the Term, or such other period of time mutually agreed upon by the parties hereto, Therapy Source shall furnish to Facility an electronic invoice that will be available in TSI Client Portal setting forth the total number of hours worked for Facility by Therapists and each such Therapist's hourly rate; with a total calculation for the costs of services for the preceding month. Therapy Source will have electronic invoicing available through our TSI Client Portal, this will be Therapy Source’s primary delivery of invoicing unless specified otherwise. It will be the Facilities responsibility to access to the invoicing through the Client Portal. 3.2. Within (30) thirty days after receipt of said invoice, Facility shall pay to Therapy Source, at its address set forth in Section 10 or such other location specified by Therapy Source, and at the times hereinafter specified, the amount of the total costs for service. If any payment is made after the due date therefor, Facility shall pay to Therapy Source a late payment charge of one and one-half percent (1½%) of the amount of such payment per month, or the maximum rate permitted by applicable law, whichever is less, for each month or fraction thereof that any payments are in arrears to Therapy Source. Such late payment charge shall be in addition to, and not in lieu of, all other remedies available to Therapy Source at law and in equity. Therapy Source may accept any check or payment without prejudice to its right to recover a balance due or to pursue any other right or remedy. No endorsement or statement on any check or payment or letter accompanying any check or payment or elsewhere will be construed as an accord or satisfaction. 3.3. Facility agrees that, for a period of one (1) years after termination of this Agreement, regardless of the reason for the termination, Facility (or any successor of Facility, including, without limitation, a successor by merger or an entity that acquired Facility’s assets or equity securities) will refrain from (a) soliciting or offering a position (indirectly or directly) to any Therapist who was provided to Facility through Therapy Source or whose name or resume Therapy Source furnished to Facility, (b) contacting or soliciting any Therapist who was provided to Facility through Therapy Source or whose name or resume Therapy Source furnished to Facilty, in an effort to induce or encourage such employe...
