Failure to Act Within Time Limits. It is the desire of both parties to this Agreement to resolve grievances in a manner that is just and equitable, and it is not the intention of either the employer or the union to evade settlement of disputes on procedural technicalities. Notwithstanding the foregoing, it is clearly understood that the time limits established are for the sake of procedural orderliness and are to be adhered. Should either party fail to adhere to the time limits, the onus is on that part to justify it failure to adhere to the time limits. If the Employer fails to observe the time limits in the steps of the grievance procedure, the grievance will be deemed to be advanced to the next step.
