FAILURE TO MAINTAIN INSURANCE COVERAGE. Regardless of any approval by Xxxxxxx County, it is the responsibility of the contractor to maintain the required insurance coverage in force at all times; its failure to do so will not relieve it of any contractual obligation or responsibility. In the event of Contractor’s failure to maintain the required insurance in effect, Xxxxxxx County may order Contractor to stop work immediately and, upon 10 days notice and an opportunity to cure, may pursue its remedies for breach of this contract as provided for herein and by law.
FAILURE TO MAINTAIN INSURANCE COVERAGE. If Franchisee fails to provide or maintain in full force and effect the Worker's Compensation, liability, or insurance coverage as required by this Agreement.
FAILURE TO MAINTAIN INSURANCE COVERAGE. If Permittee, for any reason, fails to maintain insurance coverage which is required pursuant to this Agreement, the same shall be deemed a material breach of contract. The City of Santa Xxxxxx, at its sole option, may terminate this Agreement and obtain damages from the Permittee resulting from said breach.
FAILURE TO MAINTAIN INSURANCE COVERAGE. If Developer, for any reason, fails to maintain insurance coverage, which is required pursuant to this Agreement, the same shall be deemed a material breach of contract. The City, at its sole option, may terminate this agreement and obtain damages from the Developer resulting from said breach. Alternatively, the City may purchase such required insurance coverage, and Developer shall reimburse the City for any premium costs advanced by the City for such insurance.

Alternatively, the City of Fremont may purchase such required insurance coverage, and without further notice to Consultant, the City of Fremont may deduct from sums due to Consultant any premium costs advanced by the City of Fremont for such insurance.

FAILURE TO MAINTAIN INSURANCE COVERAGE. Contractor’s failure to maintain or to provide acceptable evidence that it maintains the required insurance shall constitute a material breach of the Contract, upon which County immediately may withhold payments due to Contractor, and/or suspend or terminate this Contract. County, at its sole discretion, may obtain damages from Contractor resulting from said breach.

Alternatively, the City of Fremont may purchase such required insurance coverage, and without further notice to Artist, the City of Fremont may deduct from sums due to Artist any premium costs advanced by the City of Fremont for such insurance.

If Contractor, for any reason, fails to maintain insurance coverage which is required pursuant to this contract, the same shall be brought to Contractor’s attention in writing and, if not cured within 5 (five) business days, be deemed a material breach of contract. City, at its sole option, may terminate this contract at any time and obtainfile for damages from Contractor resulting from said breach. Alternatively, City may, upon written notice and, if not cured within 5 (five) business days, purchase such coverage (but has no special obligation to do so), and without further notice to Contractor, the City may deduct from sums due to Contractor any premium costs advanced by City for such insurance.
FAILURE TO MAINTAIN INSURANCE COVERAGE. Failure to secure and/or maintain insurance coverage shall be deemed a material breach and grounds for termination of this Agreement.
