Common use of Failure to Meet Time Limits Clause in Contracts

Failure to Meet Time Limits. If a grievance is not processed by the grievant in accordance with the time limits set forth in this Article, it shall not be subject to the procedure and shall be considered settled on the basis of the decision last made by the District. If the District fails to respond to the grievance in a timely manner at any level, the running of its time limit shall be deemed a denial of the grievance and termination of the level involved, and the grievant may proceed to the next step. Exceptions to this time limit section will be those grievances which happen just prior to the holiday break in December which take place at a time which will not provide adequate notification to the appropriate parties. In this case, an extension will be made of five (5) days to the limits applicable. Time limits hereunder may be lengthened or shortened in any particular case only by mutual written agreement. The parties will attempt in good faith to adjust time limit problems which occur above Level 1 as a result of the summer recess.
