Filing and Effective Date. This Agreement shall become effective upon the occurrence of all of (a) the execution of this Agreement by the proper officers of the City and the County as of the date set forth above and (b) upon filing with the Clerk of the Circuit Court of Xxxx County, Florida, as required by Section 163.01(11), Florida Statutes.
Filing and Effective Date. In accordance with Act 425, following the execution of this Agreement by the City and the Township (and following any period in which this Agreement shall be held in escrow), a duplicate original of the Agreement shall be filed with the Clerk of Xxxxx County and with the Michigan Secretary of State. This Agreement, certified by the County Clerk or Secretary of State, shall be prima facie evidence of the conditional transfer of the Urban Services District as specifically provided in this Agreement. This Agreement shall be effective on the date it is filed with the Xxxxx County Clerk and the Secretary of State. If this Agreement is filed with the Xxxxx County Clerk and the Secretary of State on different dates, the effective date of this Agreement shall be the later of the two filing dates. Upon becoming effective, this Agreement also amends, replaces and supersedes the Rutland Charter Township-City of Hastings Urban Services and Economic Development Agreement made November 26, 2012, as amended in 2013.

Filing and Effective Date. PSTA shall be responsible for filing this Agreement with the Clerk of the Circuit Court of Pinellas County and this Agreement shall be effective on the date of such filing (“Effective Date”). This Agreement shall commence on the Effective Date and the provisions of the Agreement applicable to the design and construction of the Project shall terminate upon completion of the construction of the Project, however maintenance responsibilities for the Project pursuant to this Agreement and any other provisions specifically noted as surviving termination of this Agreement shall continue in effect as long as PSTA operates the BRT service for the Project.

In accordance with Act 425, following the execution of this Agreement by Xxxx and Lockport, a duplicate original of the Agreement shall be filed with the Clerk of St. Joseph County, Clerk of St. Joseph County, and with the Michigan Secretary of State. This Agreement, certified by the St. Joseph County Clerk or Secretary of State, shall be prima facie evidence of the conditional transfer of the Transferred Area. This Agreement shall be effective , 2023 following the filing with the St. Joseph County Clerk and Secretary of State (“Effective Date”).

A duplicate original of this executed Agreement and of each subsequent amendment to this Agreement shall be filed with the Clinton County Clerk and the Michigan Secretary of State. Certification of filing with the Clinton County Clerk or Secretary of State shall be prima facie evidence of the conditional transfer of the Cooperative Development Area to Category 1 or Category 2. This Agreement and each subsequent amendment to this Agreement shall be effective on the day it is filed with the Clinton County Clerk and Secretary of State.
