Financial Rules and Controls. As the Accountable Body for the LAA, Westminster City Council will need to ensure that there are full and rigorous financial management mechanisms in place to ensure that a clear audit trail exists for all expenditure. The Accountable Body will need to ensure that demonstrable outputs linked to payment profiles are agreed for each project. In the case of aligned funds, financial management mechanisms will continue as at present although delivery bodies will be expected to report expenditure and performance linked to the achievement of the LAA objectives to the LAA Partnership Board and Accountable Body on at least a quarterly basis. In the case of pooled funds (locally and centrally pooled) the Accountable Body will sign funding agreements linking funding support to the achievement of outputs and targets and require delivery bodies to have robust financial regulations and processes in place. Individual projects will need to be approved corporately within the LAA governance framework and will normally be subject to a detailed appraisal process. As Westminster is currently an excellent authority the majority of our mainstream specific grant funding is paid without ring fencing. This means that there is no requirement for each grant stream to be separately audited. Central Government has agreed that no new or additional monitoring will be incurred for these streams as a result of pooling. As Westminster has been successful in securing Single Pot status, the Council, as the Accountable Body, would therefore wish, subject to the ODPM’s agreement, to prepare its six monthly financial monitoring reports on a Single Pot basis. This would mean that reporting would be provided as a single figure split between capital and revenue rather than by funding stream or by block. This has been agreed in principle by GoL. As an excellent authority Westminster has well established financial and performance monitoring arrangements in place which have been subject to accreditation by our external auditors. In the spirit of the protocols in relation to freedoms and flexibilities which have been granted by the ODPM to excellent authorities, the Council as Accountable Body should be afforded the opportunity to prepare its monitoring reports in a format consistent with the effective operation of the Local Area Agreement.

  • Accounting Controls The Company and its Subsidiaries maintain systems of “internal control over financial reporting” (as defined under Rules 13a-15 and 15d-15 under the Exchange Act Regulations) that comply with the requirements of the Exchange Act and have been designed by, or under the supervision of, their respective principal executive and principal financial officers, or persons performing similar functions, to provide reasonable assurance regarding the reliability of financial reporting and the preparation of financial statements for external purposes in accordance with GAAP, including, but not limited to, internal accounting controls sufficient to provide reasonable assurance that (i) transactions are executed in accordance with management’s general or specific authorizations; (ii) transactions are recorded as necessary to permit preparation of financial statements in conformity with GAAP and to maintain asset accountability; (iii) access to assets is permitted only in accordance with management’s general or specific authorization; and (iv) the recorded accountability for assets is compared with the existing assets at reasonable intervals and appropriate action is taken with respect to any differences. Except as disclosed in the Registration Statement, the Pricing Disclosure Package and the Prospectus, the Company is not aware of any material weaknesses in its internal controls. The Company’s auditors and the Audit Committee of the Board of Directors of the Company have been advised of: (i) all significant deficiencies and material weaknesses in the design or operation of internal controls over financial reporting which are known to the Company’s management and that have adversely affected or are reasonably likely to adversely affect the Company’ ability to record, process, summarize and report financial information; and (ii) any fraud known to the Company’s management, whether or not material, that involves management or other employees who have a significant role in the Company’s internal controls over financial reporting.

  • Financial Controls At all times, the Charter School shall maintain appropriate governance and managerial procedures and financial controls which procedures and controls shall include, but not be limited to: (1) commonly accepted accounting practices and the capacity to implement them (2) a checking account; (3) adequate payroll procedures; (4) procedures for the creation and review of monthly and quarterly financial reports, which procedures shall specifically identify the individual who will be responsible for preparing such financial reports in the following fiscal year; (5) internal control procedures for cash receipts, cash disbursements and purchases; and (6) maintenance of asset registers and financial procedures for grants in accordance with applicable state and federal law.

  • Audit Controls P. Contractor agrees to an annual system security review by the County to assure that systems processing and/or storing Medi-Cal PII are secure. This includes audits and keeping records for a period of at least three (3) years. A routine procedure for system review to catch unauthorized access to Medi-Cal PII shall be established by the Contractor.

  • Financial Reporting Requirements The Charter School shall follow the financial requirements of the Charter Schools Section of the Department’s Financial Management for Georgia Local Units of Administration Manual. The Charter School shall submit all information required by the State Accounting Office for inclusion in the State of Georgia Comprehensive Annual Financial Report.

  • Human and Financial Resources to Implement Safeguards Requirements 6. The Borrower shall make available necessary budgetary and human resources to fully implement the EMP and the RP.

  • Records and controls The Contractor shall maintain records and controls adequate for administration of this clause. The arbitrator(s) shall provide each of the Parties an opportunity to be heard and, except as otherwise provided herein, shall conduct the arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“Arbitration Rules”) and any applicable FERC regulations; provided, however, in the event of a conflict between the Arbitration Rules and the terms of this Article 27, the terms of this Article 27 shall prevail.
