Fitness for Duty Examinations, Disability Separation and Appeal. Any employee 38 absent from work due to personal illness or injury, work related or not, may, at the Employer's 39 sole discretion, be required to have a physical exam by a physician appointed and paid by the 40 Employer resulting in the physician's certification that: a) if the employee claims to be unable to 41 work, he is indeed unable to return to work; or b) if the employee claims to be able to work, he is 42 indeed able to return to work and perform all of the duties and job functions related to his 43 employment as a condition to re-employment. 44
