Common use of Formal Discipline Clause in Contracts

Formal Discipline. Unless causes for disciplinary action results in the immediate notice of discipline to the unit member, or when a unit member’s conduct and/or performance continues to be unsatisfactory after the issuance of one or more verbal warnings, the unit member may be subject to any of the following disciplinary actions: 1. Written reprimand or warning notice relating to an action or lack of action may be placed in the personnel file. The unit member shall be provided a copy and notice of opportunity to reply. The unit member must exercise his/her right to reply within ten (10) working days. The unit member’s written comments, if any, are to be attached to the reprimand or warning notice (Education Code Section 44031). 2. The unit member may be suspended for up to thirty (30) days without pay. 3. The unit member may be demoted to a lower salary classification. 4. The unit member may be terminated for cause.

If the warning is to be placed in the personnel file, the rights described in section 7.4.1.2.2 below will be afforded. 7.1.3.2.2. Written reprimand or warning notice relating to an action or lack of action may action, which shall be placed in the unit member’s personnel file. The unit member shall be provided a copy and notice of opportunity to reply. The unit member must exercise his/her right to reply within ten (10) working days.
