Formal Procedure. In the event informal resolution is not achieved, COUNTY and PROVIDER shall follow the following procedure to resolve all disputes: Step 1: PROVIDER's Chief Executive Officer shall present a description of the dispute and PROVIDER’s position, in writing, to COUNTY's Division Manager within fifteen (15) working days of gaining knowledge of the issue. The description shall cite the provision or provisions of this Agreement that are in dispute and shall present all available factual information supporting PROVIDER’s position. Failure to timely provide said document constitutes a waiver of PROVIDER’s right to dispute the item.
