Level Three - Board of Education. If the aggrieved person is not satisfied with the disposition of his grievance at Level Two, or if no decision has been rendered within ten (10) school days after the presentation of the grievance to the Superintendent, he may file the grievance in writing with the Association within five (5) school days after the decision of Level Two or ten (10) school days after the grievance was presented, whichever is sooner. Within five (5) school days after receiving the written grievance, the Association shall refer it to the Board of Education through the Business Administrator/Board Secretary.

Level Three - Board of Education. If the grievance is not resolved to the grievant's satisfaction, he, no later than five (5) work days after the receipt of the Superintendent's decision, may request a review by the Board of Education. The request shall be submitted in writing through the Superintendent, who shall attach all related papers and forward the request to the Board of Education. The Board, or a committee thereof, shall review the grievance and may at the option of the Board, hold a hearing with the grievant and shall render a decision in writing within thirty-five (35) calendar days of receipt of the grievance by the Board.
Level Three - Board of Education. (a) If the aggrieved teacher is not satisfied with the disposition of his/her grievance at Level Two, he/she may, within five (5) days after receipt of the decision, file the grievance with the Board of Education.
Level Three - Board of Education. Within seven (7) working days after receipt of the above disposition, the Member of the Bargaining Unit may, if the grievance remains unresolved, appeal the Board. The Board shall hold a formal hearing within ten (10) working days or at its next regularly scheduled meeting, whichever comes soonest, and serve a written disposition of the matter on the Member or Members of the Bargaining Unit within seven (7) working days after the hearing.
Level Three - Board of Education. 1. To appeal the decision a copy of the written grievance shall be filed, together with the decision of the Superintendent, with the secretary of the Board.

Upon receipt of the Level Three appeal, the Superintendent shall cause the School Board to have copies of all previous appeals and findings, and any other material deemed relevant to the grievance. Should the aforementioned material not have been provided to the Union, it will be delivered to the Union simultaneously with its delivery to the Board. Within twenty (20) days after receipt of the appeal, the Board shall conduct a hearing. A decision containing the reasons for the decision and evidence upon which the decision was based will be communicated in writing within ten (10) days of the hearing. The decision of the Board will be final regarding decisions of policy and administrative rules.
Level Three - Board of Education. If the grievant is not satisfied with the decision at Level Two, the grievant shall submit his/her grievance in writing to the Board of Education through the Superintendent of Schools within ten (10) calendar days after receipt of the decision at Level Two. The Board (or a committee thereof) shall conduct a hearing within thirty (30) calendar days of its receipt of the grievance and shall render a decision in writing to the grievant, Union, and Superintendent.

Level Three - Board of Education. The decision of the Superintendent shall finally determine the matter unless the aggrieved Employee appeals to the Board in writing within ten (10) workdays of receipt of the Superintendent’s written decision. A hearing shall be granted upon receipt of a written request signed by the aggrieved Employee stating a desire for a hearing on the Grievance. In such cases the Board will notify the aggrieved Employee as to the time and place of the hearing, taking into consideration the availability of the aggrieved Employee(s). The aggrieved Employee(s) involved in such hearing shall have the right:

Within thirty (30) days after receipt of the appeal, the Board shall conduct a hearing. A decision containing the reasons for the decision and evidence upon which the decision was based will be communicated in writing within fifteen (15) days of the hearing. The decision of the Board will be final regarding decisions of policy and administrative rules.
Level Three - Board of Education. In the event that the aggrieved member of the unit is not satisfied with the disposition of the grievance at Level Two, or in the event no decision has been rendered within ten (10) school days after having first met with the Superintendent or designee, the teacher may file a written grievance, indicating such dissatisfaction with the Board within five (5) school days after a decision by the Superintendent or designee or fifteen (15) school days after having first met with the Superintendent, whichever is sooner. Within ten (10) school days after receiving the written grievance, the Board or a committee of the Board shall meet with the aggrieved member of the unit and/or the President of the Association or designee for the purpose of resolving the grievance.
