Level Two - Superintendent of Schools. The grievant, no later than five (5) work days after receipt of the immediate supervisor’s decision, may appeal this decision to the Superintendent of Schools. The appeal to the Superintendent must be in writing reciting the matter submitted to the immediate supervisor as specified above and his dissatisfaction with decisions previously rendered. The Superintendent shall attempt to resolve the matter as quickly as possible, but within a period not to exceed five (5) work days. The Superintendent shall communicate his decision in writing to the grievant and the immediate superior.
Level Two - Superintendent of Schools. The Member of the Bargaining Unit may appeal the disposition made at Level One to the Superintendent or his/her official designee within seven (7) working days of the immediate supervisor’s written disposition of the grievance. The Superintendent shall arrange with the Member of the Bargaining Unit for a meeting to occur as soon as possible, but not later than seven
Level Two - Superintendent of Schools. If the aggrieved person is not satisfied with the disposition of his grievance at Level One, or if no decision has been rendered within fifteen (15) calendar days after submission at Level One, he may present it in writing on the appropriate form to the Superintendent of Schools within ten (10) calendar days thereafter.
Level Two - Superintendent of Schools a. If an aggrieved person is not satisfied with the decision concerning his/her grievance at Level One, he/she may, within three (3) days after the decision is rendered or within eight (8) days after his/her formal presentation, file his/her grievance with the Superintendent.
b. The Superintendent’s designee at this level cannot be the same administrator that heard Level One.
c. The Superintendent shall schedule a meeting to take place within ten (10) days from the receipt of the written grievance from the aggrieved with the purpose of resolving the grievance. Persons entitled to take part in this meeting shall be:
1. A maximum of three (3) administrators designated by the Superintendent, who may include himself/herself as one (1) of the three (3).
2. A maximum of two (2) Association representatives.
3. The principal or appropriate administrator who was involved at Level One.
4. The aggrieved employee and/or employees.
5. These persons shall be given five (5) days notice in writing of the time and place of the meeting. The Superintendent shall within five (5) days after this meeting, render his/her decision in writing to the aggrieved person, the principal, or appropriate administrator, and the Association.
Level Two - Superintendent of Schools a. If the grievance is not resolved to the satisfaction of the grievant within four (4) days after presentation at Level One, the grievant may, within four
Level Two - Superintendent of Schools. If an aggrieved person is not satisfied with the decision concerning the alleged grievance at Level One, they may, within seven (7) days after the decision is rendered, or within fourteen (14) days after their formal presentation, file the alleged grievance with the Superintendent.
Level Two - Superintendent of Schools. (a) If the aggrieved teacher is not satisfied with the disposition of his/her grievance at Level One, he/she may, within five (5) days after the receipt of the decision, file his/her written grievance with the Superintendent of Schools.
(b) The Superintendent shall, within five (5) days after receipt of the grievance meet with the aggrieved teacher and with the representatives of the Association, if the teacher so desires, for the purpose of resolving the grievance.
(c) The Superintendent shall, within five (5) days after the hearing, render his/her decision and the reason thereof in writing to the aggrieved teacher, with a copy to the President of the Association.
Level Two - Superintendent of Schools a. In the event that such aggrieved member of the unit is not satisfied with the disposition of the grievance at Level one, or in the event that no decision has been rendered within ten (10) school days after presentation of the grievance, the teacher may file the written grievance with the Superintendent or designee above the level of principal within five (5) school days after the decision at Level One or fifteen (15) school days after the grievance was first presented, whichever is sooner. The grievance shall be in writing and shall specify the grievance asserted, the section of the contract alleged to be involved, or the Board policy involved, if any, and its disposition at Level One.
b. The Superintendent or designee shall represent the administration at this level of the grievance procedure. Within ten (10) school days after receipt of the written grievance by the Superintendent or designee, the Superintendent or designee shall meet with the aggrieved member of the unit and/or the President of the Association or designee.
Level Two - Superintendent of Schools a. In the event the aggrieved person is not satisfied with the written disposition of his grievance at Level One, he shall, within five (5) additional days, file the grievance with the Association.
b. After receipt of the written alleged grievance, the Association shall decide whether or not there is a legitimate grievance.
1) If the Association decides that no grievance exists, the Association shall so notify the claimant in writing within seven (7) days after receipt of the written alleged grievance. The teacher may continue to process his claim through Level two (2) only, without the Association's support, as follows.
i. If the teacher is not satisfied with the disposition of the alleged grievance by the Association as outlined in 1) above, the teacher may file the grievance in writing with the Superintendent of Schools within five (5) days after receipt of written notification from the Association.
ii. Within ten (10) days after receipt of the grievance, the Superintendent shall render a decision in writing as to the solution of the grievance.
iii. If the teacher is not satisfied with the disposition of the grievance by the Superintendent as outlined in ii) above, the teacher may, within five (5) days after receipt of the decision by the Superintendent, submit a written notice of appeal to the Board of Education via the Superintendent. Such appeal shall occur within thirty (30) days of receipt of written notification to the Board.
2) If the Association decides there is a legitimate grievance the Association shall within five (5) days after receipt of the written grievance, file the grievance in writing with the Superintendent.
c. Within ten (10) days after filing the grievance in writing with the Superintendent, the Association shall meet with the Superintendent to discuss the grievance. A sincere attempt will be made by both parties to reach an amicable agreement.
d. Within ten (10) days after meeting with the Association to discuss the grievance, the Superintendent shall render a decision in writing as to the solution of the grievance.
Level Two - Superintendent of Schools a) If the aggrieved is not satisfied with the resolution at Level One or if no answer is received within five (5) days of the Level One meeting, the grievance may be submitted to the Superintendent.
b) The Superintendent shall, within ten (10) days of receipt of the grievance, meet with the aggrieved for the purpose of resolving the grievance.
c) The Superintendent shall, within five (5) days after the meeting, render his decision and the reasons therefore, in writing, to the aggrieved, with a copy to the Association.
