Common use of Fraudulent Claim Clause in Contracts

Fraudulent Claim. Any person claiming sick leave with pay and the Department Head approving the same where it is shown that such claim was made or approved by such claimant or the Department Head knowing that such claimant was not in fact sick or otherwise entitled thereto, shall forfeit all accumulated sick leave and shall not be allowed to receive or accumulate sick leave for a period of thirteen (13) pay periods thereafter. The City Manager will make the determination whether or not sick leave accrual or the accumulated sick leave is forfeited after consultation with the Department Head.

Fraudulent Claim. The first fraudulent claim will result in the forfeiture of fifty percent (50%) of any accumulated sick leave and shall not be allowed to receive or accumulate sick leave for a period of thirteen (13) pay periods thereafterthat the employee has on record. The City Manager second violation will make result in the determination whether or not sick leave accrual or forfeiture of all of the employee’s accumulated sick leave is forfeited after consultation with the Department Headleave.
