Forfeiture of Sick Leave. No Employee shall be entitled to sick leave while absent from duty on account of any of the following:
a. Disability arising from any sickness or injury purposely self-inflicted or caused by any of the employee’s willful misconduct.
b. Disability arising from any conduct which is in violation of federal, state or local statute, written City or departmental policy or direct order of the Department Director.
c. Sickness or disability sustained while on Leave Without Pay.
Forfeiture of Sick Leave. No employee shall be entitled to sick leave while absent from duty because of the following cause: Disability arising from a sickness or injury purposely self-inflicted, or caused by willful misconduct. An employee claiming sick leave with pay, and any appointing authority approving the same, where it is shown that such claim was made or approved by such claimant or appointing authority, knowing that such claimant was not in fact sick or otherwise entitled thereto, shall forfeit all sick leave which would otherwise accrue for a period of six (6) months thereafter. It is the duty of the Fire Chief to enforce this provision.
Forfeiture of Sick Leave. Any person claiming sick leave with pay, where it is shown that such a claim was made or approved by such claimant knowing that such claimant was in fact not sick or otherwise entitled thereto, shall forfeit all accumulated sick leave and shall not be allowed to receive or accumulate sick leave for a period of twelve (12) pay periods thereafter. In addition, the employee may be terminated if such fraudulent claim was made and accepted.
Forfeiture of Sick Leave. Should any driver terminate his/her employment voluntarily and/or by request of the Board and before retirement, he/she shall forfeit all unused sick leave benefits accrued.

Fraudulent Claim: Any person claiming sick leave, with pay, and the Fire Chief or designee approving the same where it is shown that such claim was made or approved by such claimant or the Fire Chief or designee knowing that such claimant was not in fact sick or otherwise entitled thereto, shall forfeit all accumulated sick leave and shall not be allowed to receive or accumulate sick leave for a period of thirteen

a. Disability arising from any conduct which is in violation of federal, state or local statute, written city or departmental policy, or direct order of the Fire Chief or designee.
b. Sickness or disability sustained while on Leave Without Pay.
c. Fraudulent Claim: Any person claiming sick leave, with pay, and the Fire Chief or designee approving the same where it is shown that such claim was made or approved by such claimant or the Fire Chief or designee knowing that such claimant was not in fact sick or otherwise entitled thereto, shall forfeit the equal number of sick leave hours that were used fraudulently. For example: if a person used 48 hours of sick leave fraudulently, they would lose an additional 48 hours of sick leave. If there are not enough hours accrued in the person’s sick leave bank, leave without pay would be used to satisfy the remaining hours. This forfeiture is in addition to, not in lieu of, and has no impact on the City’s ability to impose discipline for improper use of sick leave. It shall be the duty of the City Manager to enforce this provision.

Forfeiture of Sick Leave. Sick leave is forfeited upon termination of employment.
