Common use of FREE DAYS AND HOLIDAYS Clause in Contracts

FREE DAYS AND HOLIDAYS. (a) Each Performance Week shall have one (1) Free Day in each Monday through Sunday Week, with the Free Day occurring by not later than the tenth (10th) day following the immediately preceding Free Day. A Free Day which occurs no later than the fourteenth (14th) day following the immediately preceding Free Day may occur once on a tour in the first year of this Agreement and may only occur in subsequent years if agreed to by the ARTISTS (b) ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving, Christmas, New Year's Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at one-sixth (1/6) of the weekly salary. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. For the Spring performance, at the option of Management, ARTISTS may also have their Free Days rescheduled, so that ARTISTS will have the Friday off prior to a Performance Week and will rehearse on the Sunday of a Performance Week for three (3) hours in addition to the Saturday for Monday exchange referred to in the preceding sentence. (d) For tours which are in excess of twenty-one (21) days, the EMPLOYER shall designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination. In a week where the Free Day is scheduled on a day other than Sunday due to the requirements of this subparagraph, any other rehearsal days Monday through Friday will be 5.5 rehearsal hours, and Saturday will be 3 rehearsal hours.

If the ARTIST is required to perform or rehearse on a legal holiday set forth below or if the holiday is scheduled to be celebrated on the regular Free Day, the ARTIST shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment except for the following holidays: Thanksgiving Day, Christmas Day and New Year's Day. On these holidays, the extra Free Day may be scheduled within the succeeding or preceding four (4) week period of employment. In the event that an alternate Free Day cannot be scheduled, the ARTIST will be compensated at one-sixth (1/6th) of the weekly salary. Each Performance Week performance week shall have one (1) Free Day in each Monday through Sunday Week, week with the Free Day occurring by not later than the seventh (7th) day in the City of Origination, and the tenth (10th) day on tour or during NUTCRACKER, following the immediately preceding Free Day. A Free Day which occurs no later than the fourteenth (14th) day following the immediately preceding Free Day may occur once on a tour in the first year of this Agreement and may only occur in subsequent years if agreed to by the ARTISTS. (b) ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, ThanksgivingThanksgiving Day, ChristmasChristmas Day, New Year's Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two Days as set forth in (2a) week period of employment except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at one-sixth (1/6) of the weekly salaryabove. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two six (2) week period of employment except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day which shall have the extra Free Day scheduled within the succeeding or preceding four (46) week period of employment. Requests from EMPLOYER to schedule a free day outside of this period may be discussed and mutually agreed to by the AGMA Committee and shall not unreasonably be denied. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at one-one- sixth (1/6) of the weekly salary. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. For the Spring performance, at the option of Management, ARTISTS may also have their Free Days rescheduled, so that ARTISTS will have the Friday off prior to a Performance Week and will rehearse on the Sunday of a Performance Week for three (3) hours in addition to the Saturday for Monday exchange referred to in the preceding sentence. For tours which are in excess of twenty-twenty one (21) days, the EMPLOYER shall designate the Free Day on the first business day or a mutually agreeable day immediately following the Company's return to the City of Origination. In a week where the Free Day is scheduled on a day other than Sunday due to the requirements of this subparagraph, any other rehearsal days Monday through Friday will be 5.5 rehearsal hours, and Saturday will be 3 rehearsal hours.

The EMPLOYER shall not be required to provide an extra Free Day for Easter Sunday unless the ARTISTS are required to perform or rehearse on Easter Sunday. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. For the Spring performance, at the option of Management, ARTISTS may also have their Free Days rescheduled, so that ARTISTS will have the Friday off prior to a Performance Week and will rehearse on the Sunday of a Performance Week for three (3) hours in addition to the Saturday for Monday exchange referred to in the preceding sentence. A Notwithstanding the foregoing the EMPLOYER is allowed a span of eleven (11) days between Free Day which occurs no later than the fourteenth (14th) day following the immediately preceding Free Day may occur once on a tour Days in the first year of this Agreement and may only occur in subsequent years if agreed to by the ARTISTSPerformance Weeks one (b1) time per contract year or a span of twelve (12) days between Free Days in Performance Weeks on tour. 1) ARTISTS may not be required to rehearse and/or perform perform, on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving, Christmas, New Year's Day and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. If the ARTIST is required to perform or rehearse Free Days shall not be scheduled on a legal holiday or holidays. During Rehearsal Weeks, if the holiday is falls on a scheduled to be the regular Free Day, it shall be observed on the preceding Friday. 2) ARTISTS may rehearse or perform on a holiday during Performance Weeks and the week preceding a Performance Week. Except as otherwise agreed to by the parties, any such holidays shall be observed on the first (1st) work day after the conclusion of the Performance Week(s). An EMPLOYER shall utilize its best efforts not to schedule rehearsals on holidays during the Rehearsal Week preceding a Performance Week. 3) ARTISTS may be required to travel on a holiday to depart to or return from a tour. Except as otherwise agreed to by the parties, any such holiday shall be observed on the first (1st) work day following the conclusion of the tour. EMPLOYER shall utilize its best efforts not to schedule tour departure on a holiday 4) Except as provided above, an ARTIST who rehearses or performs on a holiday will receive an extra Free Day within the succeeding or preceding two (2) week period of employment except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled ARTISTS will be compensated at additional one-sixth (1/6) of the their weekly salary. Legal holidays which fall on a Sunday do not require an additional Free Day during that same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. For the Spring performance, at the option of Management, ARTISTS may also have their Free Days rescheduled, so that ARTISTS will have the Friday off prior to a Performance Week and will rehearse on the Sunday of a Performance Week for three (3) hours in addition to the Saturday for Monday exchange referred to in the preceding sentence. A In a Performance Week in the City of Origination with a Sunday performance, the Free Day which occurs no later than the fourteenth (14th) day following will be the immediately preceding following Monday, but if that Free Day may occur once on falls in a tour layoff week, no Free Day is required, and ARTISTS shall not be paid for that day. (c) Except as set forth in the first year of this Agreement and may only occur in subsequent years if agreed to by the ARTISTS (b) following sentence, ARTISTS may not be required to rehearse and/or perform on the following legal holidays: Labor Day, Independence Day, Memorial Day, Xxxxxx Xxxxxx Xxxx Day, Thanksgiving, Christmas, New Year's Day Day, and Easter Sunday. All such legal holidays shall be in addition to the regularly scheduled Free Days. If If, however, the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduled to be the regular Free Day, the ARTISTS shall receive an extra Free Day within the succeeding or preceding two (2) week period of employment employment, except Thanksgiving, Christmas, New Year's Day and Xxxxxx Xxxxxx Xxxx Day Day, which shall have the extra Free Day scheduled within the succeeding or preceding four (4) week period of employment. If an alternate Free Day cannot be scheduled scheduled, ARTISTS will be compensated at one-sixth (1/6) of the weekly salary. The EMPLOYER will provide 45 days’ notice if the Friday after Thanksgiving is a free day. Legal holidays which fall on a Sunday do not require an additional Free Day during that the same week, provided the ARTIST shall have an alternate Free Day scheduled. (c) During the transition from a Rehearsal Week to a Performance Week, at the option of Management, ARTISTS may have their Free Days rescheduled, so that ARTISTS will have the Saturday off prior to a Performance Week and will rehearse on the Monday of a Performance Week for three (3) hours. For the Spring performance, at the option of Management, ARTISTS may also have their Free Days rescheduled, so that ARTISTS will have the Friday off prior to a Performance Week and will rehearse on the Sunday of a Performance Week for three (3) hours in addition to the Saturday for Monday exchange referred to in the preceding sentence. (e) In the event that the ARTIST is called to rehearse at any time during a week where the Free Day is scheduled on a day other than Sunday due to the requirements as defined in Paragraph 38(j) of this subparagraphAgreement, any other rehearsal days Monday through Friday will the ARTIST shall be 5.5 rehearsal hours, and Saturday will compensated at the following hourly rates: Free Day Rate ARTIST’s hourly base rate x 2.5 payable in one-half (1/2) hour increments with not less than a two (2)-hour call. There shall be 3 rehearsal hoursno pyramiding or double-payment of this payment with Overtime.
