OVERTIME AND HOLIDAY PAY. 5.3.1 All hours worked by an employee in excess of eight (8) hours per shift and in excess of forty (40) straight time hours per week shall be paid for at the rate of one and one-half times the straight time rate. All hours worked by an employee in excess of ten (10) hours per shift and all hours worked on Sunday shall be paid at the rate of double the straight time rate.

If one of the holidays in Art. falls on Sunday, it shall be observed on Monday. Accordingly, if such an event occurs, work performed on Monday shall be paid for at double the straight time hourly rate. If no work is performed on Monday, no pay shall be required other than waiting time if applicable. In the event that one of the above holidays falls during the work week, the Employer, at his option, designate an alternate day to he substituted for such holiday in order to provide, where possible, for a long weekend. Vacation and statutory holiday pay shall he ten percent (10%) of total earnings of an employee which shall he to include the Employer’s obligations similar covering vacation pay statutory pay by applicable Government Orders or Regulations. Where the applicable Governmental Orders or require payment in excess of the percentages provided for herein, payment shall be made in accordance with such Orders or Regulations. On each paycheque or at termination of employment, whichever first occurs, the employee will receive vacation pay and statutory holiday pay.

Employees working a shift other than a normal shift shall be paid a rate ten percent (10%) higher than the straight time rate, however this premium shall not apply when the Employer is performing the work as a “double shift” or “triple shift” project.
