OVERTIME AND HOLIDAY PAY. 5.3.1 All hours worked by an employee in excess of eight (8) hours per shift and in excess of forty (40) straight time hours per week shall be paid for at the rate of one and one-half times the straight time rate. All hours worked by an employee in excess of ten (10) hours per shift and all hours worked on Sunday shall be paid at the rate of double the straight time rate. 5.3.2 Additional holidays recognized in the Construction Industry in each geographical area will be observed on all work covered by this Appendix.

OVERTIME AND HOLIDAY PAY. 9.1 The work week shall begin on Sunday and shall end Saturday. All hours worked by an employee in excess of eight (8) hours per shift and in excess of forty (40) straight time hours per week shall be paid for at the rate of time and one-half the straight time rate. All hours worked on Saturday shall be paid at the rate of time and one-half the straight time rate and all hours worked on Sunday shall be paid at the rate of double the straight time rate. Work performed on New Year's Day, Family Day, Good Friday, Victoria Day, Canada Day, first Monday in August, Labour Day, Thanksgiving Day, Christmas Day, and Boxing Day and any such day proclaimed a general holiday by the Federal or Provincial Governments shall be paid for at double the straight time hourly rate, provided that where one of the holidays above mentioned falls during the work week, all hours worked that week by an employee, other than on Saturday, Sunday or the holiday, in excess of ten (10) hours per shift and forty (40) straight time hours shall be paid for at the rate of time and one-half the straight time rate. Upon mutual agreement, in writing, between the Employer and the Local Union business representative the regular work week may be adjusted to allow for the working of four consecutive regular work days consisting of four ten hour days. 9.2 If one of the holidays in paragraph 9.1 falls on Sunday, it shall be observed on Monday. Accordingly, if such an event occurs, work performed on Monday shall be paid for at double the straight time hourly rate. If no work is performed on Monday, no pay shall be required other than waiting time if applicable. In the event that one of the above holidays falls during the work week, the Employer, at his option, may designate an alternate day to be substituted for such holiday in order to provide, where possible, for a long weekend. 9.3 Vacation and statutory holiday pay shall be ten percent (10%) of total earnings of an employee which shall be deemed to include the Employer's obligation to make similar payments covering vacation pay and statutory holiday pay by applicable Government Orders or Regulations. Where the applicable Governmental Orders or Regulations require payment in excess of the percentages provided for herein, payment shall be made in accordance with such Orders or Regulations. The hours of work are contained in the Schedules as set forth in the respective appendices attached to and forming part of this Agreement. 9.2 If one of the holidays listed in the Appendices and/or Schedules contained in this Agreement, falls on Sunday, it shall be observed on Monday. Work performed on Monday will be paid for at double the straight time hourly rate. If no work is performed on Monday no pay shall be required. In the event that one of the above holidays falls during the work week the Employer and the Local Union, by mutual consent, may designate an alternate day to be substituted for such holiday in order to provide, where possible, for a long weekend during the pay period. 9.3 Vacation and statutory holiday pay shall be ten percent (10%) of total earnings of an employee paid on each paycheque, which shall be deemed to include the Employer's obligation to make similar payments covering vacation pay and statutory holiday pay by applicable Government Orders or Regulations. OVERTIME AND HOLIDAY PAY. (A) The work week shall begin Monday and shall end Sunday. All hours worked by an Employee in excess of eight (8) hours per day and in excess of forty (40) straight time hours per week shall be paid for at the rate of time and one-half the straight time rate. Work performed on Sundays shall be paid for at the rate of time and one-half the straight time rate. After an Employee has worked more than sixteen (16) hours, he will be on double his straight-time rate for all hours worked (starting with the 17th hour for work). Employee will be paid double time for hours worked until the end of that shift. At the start of his next regular shift, the Employee will be paid time and one-half the straight time rate for hours worked until he is given at least an eight (8) hour break from work. After he has been given an eight (8) hour break from work he will revert to his applicable rate at the start of his next regular shift. Reporting time pay provisions will not apply when on overtime pay; however, Waiting Time as provided for in this Agreement will apply. Work performed on Christmas, Thanksgiving, Labor Day, New Year’s Day, Memorial Day and July 4 shall be paid for at double the straight time hourly rate; provided, however, that in the event one of the holidays hereinabove named occurs during the first forty hours of any work week, hours worked on such holidays shall not be counted in computing the forty hours after which the Employee is entitled to a rate of time and one-half the straight time rate. (B) All Holidays named in paragraph (A) above shall be observed on the day on which they occur.

OVERTIME AND HOLIDAY PAY. A. Holiday Pay Rates Employees who are required to be on duty on holidays observed by the Board will receive premium pay. Employees shall receive hourly rates as follows: 1. Any employee recalled to work with less than an eight (8) hour rest period shall be paid at one and one-half times the straight time rate for all hours worked until conclusion of that shift.
