Common use of General Eligibility Clause in Contracts

General Eligibility. a. Employees in Unit B will be eligible for a salary increase if (i) he or she is employed in a Unit B position as of the date of the ratification of this Agreement by the Board and the Union or July 1 of the fiscal year (for academic support professionals) or September 1 of the academic year (for annually contracted faculty) in which the salary increase is granted, whichever is later, and either (ii-a) he or she is an academic support professional who was employed prior to March 1 of the previous fiscal year in either a position described in Appendix A or in a position which has been newly classified as a bargaining unit position effective with the current fiscal year, or (ii-b) he or she is an annually contracted faculty member employed in a position described in Appendix A AND was employed by the University as an annually contracted faculty member at least 50% during the immediately preceding academic year, or (ii-c) he or she is returning to a previously held Unit B position following employment in a permanent full-time position at the University for at least one academic term during the previous academic year. b. An employee shall not be eligible for the fiscal or academic year's salary increases if prior to his or her employment in a Unit B position, the employee has received a salary increase from the University for the fiscal or academic year, as appropriate.
