General obligations of the Processor. 4.1 The Processor processes personal data exclusively within the scope of the Main Agreement made and in compliance with documented instructions issued by the Controller. The purpose, type and scope of data processing shall be governed exclusively by this Addendum, the Main Agreement and/or documented instructions of the Processor.

The Processor undertakes to Process the Personal Data in accordance with applicable Data Protection Rules; specifically, with respect to Personal Data from the European Economic Area or Switzerland, in accordance with its obligations as a data processor under its Privacy Shield certification. The Processor undertakes that it will Process the Controller’s Personal Data on behalf of the Controller and only in compliance with its Instructions, as described in Appendix 1, and under the provisions of this Addendum. The Processor will also inform the Controller about any relevant changes concerning the Processing of its Personal Data.

General obligations of the Processor a) The Processor shall process personal data only within the framework of this Agreement and/or in compliance with possible additional instructions given by the Controller. Excluded from this are legal provisions, which potentially oblige the Processor to a different processing of data. In such a case, the Processor shall inform the Controller of these legal requirements before the processing, unless the law in question prohibits such notification on account of an important public interest. Purpose, nature and scope of data processing shall be governed exclusively by this Agreement and/or the instructions of the Controller. Data processing deviating from this Agreement shall be forbidden, unless the Controller has given its written consent.

You are granted a limited, non-sublicensable, non- transferable revocable license to use such firmware and software in object code form (without making any modification thereto) strictly in accordance with this Agreement. You acknowledge and understand that you are not granted any other license to use the firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services. You expressly agree that you will use Atlantic Broadband Equipment exclusively in connection with the Services. You shall not reverse, compile, disassemble, or reverse engineer or otherwise attempt to derive the source code from the binary code of the firmware or software. If you decide to use the Services through an interface device not provided by Atlantic Broadband, which Atlantic Broadband reserves the right to prohibit in particular cases or generally, you warrant and represent that you possess all required rights to use that interface device with the Services, including all software and firmware licenses. You will indemnify and hold harmless Atlantic Broadband against any and all liability arising out of your use of such interface device with the Services.
