Geographic Limitations. No geographic limitation on the use of occupational injury leave shall be imposed if:
Geographic Limitations. You may not use or otherwise export or re-export the Software except as authorized by United States law and the laws of the jurisdiction in which the Software was obtained. In particular, but without limitation, the Software may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Application, you represent and warrant that you are not located in any such country or on any such list. You further agree that you will not use the Software for any purposes prohibited by United States law.
Geographic Limitations. Geographic restrictions or limitations may apply to certain Hardware Support Levels and are described in the Hardware Support Location Matrix (under “Documentation”) on the Service Portal.

Notwithstanding the foregoing, ALC or any of its affiliates, EHSI and any affiliates or subsidiaries of EHSI, may, directly or indirectly, operate, own, manage or have a legal or beneficial interest in assisted living facilities within such four (4) mile radius, if ALC or any of its affiliates, EHSI and any affiliates or subsidiaries of EHSI, operated, owned, managed or had any legal or beneficial interest in or otherwise participated in or received revenues from such assisted living facility prior to the Commencement Date (a “Competing Facility”); provided, however, that in order to avoid any conflict of interest with respect to any non-LTC owned facility and a Competing Facility, ALC agrees it will not prefer or favor a Competing Facility to the detriment of an LTC-owned facility.

Force Majeure. BancTec is not liable for any failure or delay in performance due to any cause beyond its control such as, but not limited to, acts of God, acts of government, fire, explosions, epidemics, quarantine restrictions, strikes, lockouts, embargoes, severe weather conditions or delays in transportation. In any event, if BancTec’s ability to render repair services is impaired by you or circumstances beyond BancTec’s control, BancTec may terminate this Agreement. IMPORTANT NOTICE Prior to requesting services, it is your responsibility to back up the software and data on your System's hard disk drive and on any other storage device(s) in the System. BancTec is not responsible for any loss of any software or data. Please note that if you move or sell your System into a geographic location in which the Service coverage described on your invoice is not available, your Service may be automatically changed to categories of Service that are available at such price or a lesser price in such new location with no refund available. WARRANTY EXCLUSION. BANCTEC MAKES NO WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BANCTEC EXPRESSLY DISCLAIMS ALL WARRANTIES.
Geographic Limitations. Lessee acknowledges that a fair return to Lessor on its investment in the Leased property is dependent, in part, on the concentration on the Leased Property during the Term of the assisted living business of Lessee and its Affiliates in the geographical area of the Leased Property. Lessee further acknowledges that diversion of residents and/or patients, as applicable, from any Facility to other facilities or institutions owned, operated or managed, whether directly or indirectly, by Lessee or its Affiliates will have a material adverse impact on the value and utility of the Leased Property. Accordingly, Lessor and Lessee agree as follows:

No geographic limitation on the use of occupational injury leave shall be imposed if: A doctor has certified that travel will not prolong the recovery period or cause additional injury prior to the travel; travel will not interfere with previously scheduled therapy or doctor’s exams; travel will not interfere with activity such as court dates; the Employer has been given seven (7) days notice of the travel, and; notify the Employer of the location and phone number so the employee can be reached. However, if the request for occupational injury leave follows a denied leave request for the same period of time, the Employer may require documentation of the occupational injury leave request and may impose geographic restrictions.
