Grade of Fuel Oil. 6. Transporter name The Supplier shall also ensure each delivery note is accompanied with Certificate of Analysis complying with the requirements set out in Annexure A and B. Dangerous goods declaration should also accompany all trucks. The Supplier must ensure that all delivery trucks pass over the nominated weighbridge, and are weighed upon entering and before leaving the Eskom Facility. Each Eskom Facility will make available to the Supplier their Offloading Procedure to which the supplier must comply to. For any deviation noted on specification (rejected load), the respective Site Representative will issue to the Supplier a Non- Conformance Report and to which the supplier must respond. Other Non-Conformance Reports may be a detailed investigation to be carried out by the specific Site Representative together with the Supplier, Eskom National Contracts/Supply Manager and/or any other stakeholders that will be deemed necessary and communicated at such time. Eskom may change or re-direct the delivery of an intended supply of Fuel Oil to an alternate Eskom Facility. Should a delivery be re-directed to an Eskom Facility not in the cluster normally supplied by the Supplier, Eskom will reimburse Supplier for all auditable, necessary and duly substantiated transport costs incurred by Supplier. Payment of such costs will be made in accordance with the payment mechanism of this contract.

  • Petroleum Storage Systems A. At Company’s expense, Company will at all times comply with all federal, state, and local requirements, including but not limited to, the regulations of the FDEP as stated in Chapters 62-761 and 62-762, FAC, the requirements of the Federal Oil Pollution Prevention regulation found in Title 40 of the Code of Federal Regulations Part 112 (40 CFR part 112), as well as the requirements of the Environmental Protection Commission of Hillsborough County (EPC), as may be amended or replaced, pertaining to petroleum storage tank and piping system construction, operation, inspection, and compliance monitoring programs; release detection methods and procedures; maintenance; and preventative maintenance programs. Company will be responsible for all spillage, overflow, or escape of gases, petroleum or petroleum products, and for all fines and penalties in connection therewith. All petroleum storage systems will be registered by Company, and Company will display the registration placard as required by law.

  • Delivery Point (a) All Energy shall be Delivered hereunder by Seller to Buyer at the Delivery Point. Seller shall be responsible for the costs of delivering its Energy to the Delivery Point consistent with all standards and requirements set forth by the FERC, ISO-NE, the Interconnecting Utility and any other applicable Governmental Entity and any applicable tariff.

  • Fuel Surcharge NO FUEL SURCHARGES allowed during the term of this contract or any of its extensions. The Successful Contract will not xxxx Xxxxxxx County for any fuel surcharges throughout the term of this contract and its extensions.

  • Natural Gas 21.1 Subject to Article 21.2, the Indian domestic market shall have the first call on the utilisation of Natural Gas discovered and produced from the Contract Area. Accordingly, any proposal by the Contractor relating to Discovery and production of Natural Gas from the Contract Area shall be made in the context of the Government's policy for the utilisation of Natural Gas and shall take into account the objectives of the Government to develop its resources in the most efficient manner and to promote conservation measures.

  • SHIPPING AND AIR TRANSPORT 1. Profits of an enterprise of a Contracting State from the operation of ships or aircraft in international traffic shall be taxable only in that State.

The TIPS Member may cancel the order if the delay is not commercially acceptable or not consistent with the Supplemental Agreement applicable to the order.
