GRADING OF ROADS. Developer shall grade all roads to the design sub grade elevation prior to the start of construction on any utility and shall advise the City in writing of any changes which may be contemplated during construction. If Developer changes the sub grade elevation of the road after completion of the Extensions or any part thereof, Developer shall be solely responsible for all costs incurred to raise or lower the utility as required as a result of said change in sub grade elevation.

GRADING OF ROADS. The Developer shall grade all roads to the design subgrade elevation prior to the start of construction and shall advise the District in writing of any changes which may be contemplated during construction. If the Developer changes the subgrade elevation of the road after completion of the extension, or any part thereof, the Developer shall be responsible for all costs incurred to raise or lower the sewer lines and/or sewer services as required to return sewer line to design depth, as a result of said change in subgrade elevation. This obligation shall remain in full force until Snohomish County or other applicable agency having jurisdiction over the streets and roadways releases the right- of-way or road construction bond or bond of other description in connection with the Developer's obligation to the County for restoration of the roads and streets on which construction has been performed or affected.
GRADING OF ROADS. The Developer shall advise the District in writing of any changes that may be contemplated during construction. If the Developer changes the subgrade elevation of any road after initial approval of the plans, the Developer shall be responsible for all costs incurred by the District as a result of such change in subgrade elevation. This obligation shall continue in full force until Xxxxx County and/or any other governing agency releases the right- of-way or road construction bond, or releases any bond of other description that is provided to ensure the Developer’s obligation to the County or other agency for completion of roads within the area of the extension.

If the Developer changes the subgrade elevation or the road after completion of the water main construction, or any part thereof, Developer agrees to raise or lower the water main and/or water services as required by the new subgrade elevation at no cost to the District. This obligation shall remain in full force until the District or other municipality releases the right-of-way or road construction bond or bond of other description relating the Developer’s obligation to the District or County in respect to the completion of roads within the area.

  • Heating of Room Throughout the Term the Manager will provide a heating system sufficient to provide a comfortable temperature in the Room and will operate, maintain and repair that heating system. During any period in which the heating system is not functioning to the standards set out above, the Manager will use commercially reasonable efforts, after receiving notice of the deficiency, to have the system repaired and functioning as soon as may be possible in the circumstances.
