Common use of Grievance Definition and Procedure Clause in Contracts

Grievance Definition and Procedure. A grievance shall be defined as any difference between the parties regarding the interpretation or application of any of the provisions of this Agreement. Such difference shall be treated as a grievance and an xxxxxxx effort shall be made to settle such difference immediately through the following procedure: Step 1: Within five (5) working days after the occurrence of an event upon which a grievance is based, an employee having a grievance and/or a Shop Xxxxxxx shall submit a written grievance notice to the Office of Human Resources, stating precisely the character of the grievance, the section or sections of this agreement allegedly violated, and the remedy sought. The Supervisor shall respond in writing to the grievance within five (5) working days after submission of the grievance. If the Union is not satisfied with the Supervisor's response, the grievance may be appealed in writing to Step 2 within five (5) working days after receipt of the Supervisor's response. Step 2: A conference will be held between the employee submitting the grievance, a Shop Xxxxxxx, a Union representative, the Office of Human Resources, and designated representatives of the University within fifteen (15) working days of receipt of the appeal. The University's decision shall be due in writing within ten (10) working days after the conference is held. If the grievance remains unsettled, it may be appealed by the Union within fifteen (15) working days after receipt of the University's written decision. If a settlement has not been reached at this point, the grievance shall be escalated to mediation.
