Headlease. 7.26.1 If applicable to observe all of the non-financial covenants on the part of the Landlord (as lessee under the Headlease) as set out in the Headlease of the Premises a copy of which has been provided to the Tenant prior to the date of this tenancy.
Headlease. Forfeiture proceedings with respect to the Headlease are commenced or the Headlease is forfeited.
Headlease a) You will observe and perform the tenant’s covenants in the Headlease (if any) (save for in respect of any payments due under it) and any regulations that you are informed of.
b) In addition to clause 6.14(a), if Your Home is located in our Vantage Point development, you acknowledge and confirm that you will comply with Clause 24.1 of the Headlease of which London Underground Limited is the landlord.
c) If Your Home is located in either of our Union Wharf developments (Xxxxxxx Point and Xxxxxx Heights) Your Home will be located next to Brewery Wharf (the “Wharf”) which is an operational commercial working wharf. The Wharf may operate 24 hours a day and/or on seven days a week. There may be ways in which you can control the level of noise within Your Home, for instance keeping windows closed and using ventilation within Your Home. You may not and you agree not to issue any formal or informal complaint or make or pursue any claim for nuisance or damages caused by noise from the Wharf to: us; the owner or operator of the Wharf; or the Council, provided any such noise does not exceed such level as is set out in the planning documents relating to the Building.
Headlease. Forfeiture or irritancy proceedings with respect to a Headlease are commenced or a Headlease is forfeited or irritated.
Headlease. To pay the rents reserved by the headlease under which the Landlord holds the Building and to observe and perform the Tenant's covenants under the headlease unless the obligation to do so falls upon the Tenant by virtue of this Lease.
Headlease. 7.25.1 If applicable to observe all of the non-financial covenants on the part of the Landlord (as lessee under the headlease) as set out in the headlease of the Premises a copy of which can be provided upon request at any time.
Headlease. Any proceedings are commenced relating to the forfeiture or irritancy of any Headlease (other than in circumstances where the Facility Agent and the Company agree that relief from forfeiture or protection from irritancy will be obtained) or any Headlease is forfeited or irritated.
Headlease. (a) Except as disclosed in the Property Report relating to a Property:
(i) nothing has occurred which would entitle a person to terminate, repudiate or rescind, or give a notice of termination of, a Headlease;
(ii) it is not aware of any material breach or material non-compliance under any Headlease; and
(iii) there has been no variation to, or waiver, release, assignment, assignation, novation or transfer of, a Headlease since the date of its execution.
Headlease. Forfeiture proceedings are commenced against an Obligor under a Headlease or a Headlease is forfeited, provided that an Event of Default will not occur if the Agent is satisfied that such Obligor has commenced an action for relief against forfeiture within five Business Days of the date of commencement of such proceedings, is at all times using all reasonable endeavours to pursue such action and is acting in accordance with the directions of the Agent in respect of such action.
